The .net TLD is recognized by the Internet Assigned Names Authority as a generic TLD, not native to any country -- indeed, it is maintained by a corporation named Verisign, which, to my knowledge, does not deny TLD membership on the basis of server location.

Ok...so are you attempting to fortify my (1) reasoning for switching?

It didn't "die" out, it was forced off the net by cheatman. The site itself was only growing, and doing extremely well. I just felt I had to say something because of my former staff member saying things on your forum.

I really didn't want the site to end, but I didn't have much choice...

No, I'm trying to refute your only argument meant to support your reasoning that there is a reasonable argument to be found in the fact that people hate the US more than the British.

Ok...it still died irrespective of the unfortunate circumstances in which it died. These things do happen when you don't go through a respectable and well-known registrar. We've cut out the problem by purchasing our own TAG for .co.uk domains (we are our own registar) and purchasing an eNom reseller account.

Hide my nationality not out of shame or the realisation that people may not like the British, but in the realisation that if people see ".co.uk" they may think we're UK selective, which we're not. Yes, I know I should have went through a more respectable registrar. It's unfortunate, but things like this happen.

Wll this usually happen, when you puchase domain and hosting from the same provider as one service. When you want to change hosting provider, you see that domain whois shows not your, but previous host's details. So it is better to buy domain and hosting as independent services or purchase domain directly from GoDaddy, EV1 or other.

sorry this is probably basic but, "INTERNET = INTERNATIONAL NETWORK" so who cares if Dark is based in the UK, I am based in the UK and I myself own 3 .co.uk's. One of which is soon moving to GamingSource.NET (www.simstopia.co.uk). I am proud to be British, not so proud to be classed as European but who cares, we are all on the same planet. I have no problem with Americans or any other nation. Personally never realised that people hate us so much, not our fault we invented the language that you speak and then you take the piss out of our accent, ok kinda falling away from my point now.

What I am trying to say is that it doesn't matter what country you are from what so ever. Dark brought GamingSource.co.uk and then purchase GamingSource.NET, he is using the .NET because it is a network of fansites. Many sites have the domains related to different countries or topics, look at msn or google, they both have .co.uk and .com and many others, they use them because they can get more hits that way. Anyways Dark is in the write, he got the .NET in a legit way and the surcumstanses around that domain are not his fault or problem.

ICANN would have something to say about Cheatman if you can prove he violated domain laws that have been set out.

If they found Cheatman in the wrong they can still remove the domain from the owner who brought it from the illegal sale.

That all depends - Dark0ne could be considered an owner in good faith, in which case he is the legally correct owner of the domain (property). The case that he would have against anyone would be against Cheatman, which could very easily be determined to be monetary in nature (getting value of property rather than specific property in return).

To have recourse against Dark0ne he would have to prove that Dark0ne was not a good faith buyer (since there has already been at least one intermediary, the auction house if I am following the course of events correctly, this would probably be rather difficult to prove), or that he acted knowingly in that the property was wrongfully up for auction.

Like I said - his best bet is to bring suit against Cheatman, but then he will have to prove his damages (monetary amount, not anything to do with emotional stuff).

All of this is based on business law here in the states, not sure if domain name law is the same, but seems to all stem from english common law.

This all goes down the drain if the domain was actually purchased by Cheatman.com -- if it was, then Cheatman was the owner of the domain and nothing can be done.
