There would be no trial for the Stormcloaks, let alone Ulfric himself. It's just a sentencing, and execution. Remember the beginning of the game? In fact, one of the huge themes of the game itself is the extent the new Empire has gone to in-order to enforce edicts/treatises within the White-Gold Concordat, and control over an increasingly divided Skyrim. i.e. the public executions of "traitors".
Hell, High King Torygg was very-close to leaving the Empire. It's been said by Sybille that if Ulfric had simply asked Torygg to, he would've considered, and possibly enacted upon leaving the Empire in-order to preserve Skyrim's honor/independence in face of post White-Gold Concordat edicts. Plus, the Empire's not really much of an Empire without any of it's holdings: Black Marsh seceded in order to invade Morrowind, Morrowind seceded following the Empire's complete lack of aid during the Oblivion Crisis, Red Year, and the subsequent Argonian invasion/attempted genocide of the Dunmer peoples, Elsweyr joined Alinor, Valenwood was annexed by Alinor, Hammerfell seceded after being betrayed by the Empire following the Second Battle of the Imperial City/signing of the White-Gold Concordat, and Daggerfall pulled out of Imperial politics. One of the major themes of the Elder Scrolls timeline, is the cyclical nature of the Empire's history throughout the ages.
1.) New dynasty established by a divine-blessed/Lorkhan-blessed Dovahkiin (Pelinal/Morihaus, Reman, Hjaalti/Tiber Septim, etc...).
2.) Old Empire eventually collapses internally due to civil strife, corruption, famine, and external conflict.
3.) A new Dovahkiin unites the Nords, and stomps the Colovian Estates/High Rock into submission. Forming a new Dynastic Empire.
4.) Rinse, repeat.
Story embellishment is all well-and-nice. But the direct themes of TESV establish these facets. *Shrugs* Fanfic is fanfic I suppose. Otherwise, pretty cool set concept.

First off, allow me to thank you for stopping by and leaving such an interesting comment.
Now, just like you said, this is fan fiction, however, I think you are exaggerating a bit, there is nothing impossible about my suggestion of a trial for the Stormcloaks, letting alone the volatile nature of politics in this world or any other, even if the Empire is as adamant on it's persecution of dissidents as you stated, General Tullius is not the Empire, he is just a man with a mind of his own, who deals with matters in his own way, and bestowed with the authority to quell the rebellion in any way he sees fit. Also, let's not forget about Ulfric's status as a Jarl of Windhelm, whose alleged crime was in accordance with the traditional laws of Skyrim, which have a great weight with it's people, and the fact that any half-witted ruler would be willing to bend any doctrine if given the chance to end a would-be-direly-costly war with a single political move, specially taking into account the Empire's cold war with the Altmer and it's resulting desperate need of soldiers, it would be outright idiotic not to consider such a bargain.
