But youtubers are allowed to use (most)copyrighted music if the leave credit in the description. It shud be the same right?

Don't own it? Can't use it without permission.

And if you notice YouTube is one of the biggest pirate sites on the net. Charging to view whatever their users can steal and upload for free. Most certainly don't use YouTube as an example.

No.

You should read up on the different terms of agreement on different sites. It's not a "One size fit all" system on the internet. The CK EULA is strict, TheNexus is even stricter. If you do not own the copyright, or got a written permission by the one holding it (And you better be sure that person IS the rightful owner of the content), then you can not put it into a mod and upload it in any way, shape or form.

The thing is, no, they aren't. They just don't care until the lawyers rush in, or YouTube itself takes it down following a DMCA claim or the obvious rights holders' requests.

Especially the term "fair use", which they always seem to protect the legality of their uploads with, in fact simply does never apply at all to what they're doing. It's just never debunked publicly, because when YouTube pulls the video the fair use nonsense claim on top is gone as well, and the next one tries the same stunt again, not knowing it already failed spectacularly.

Have a read inside this topic, it's really helpful information linked to at the end especially.

Unlike YouTube the Nexus simply can't risk a law suit. A single one would already put an end to it all. And unlike YouTube the Nexus also can't risk having too many DMCA claims filed against material hosted on the site. That's why the rules are so strict on here unlike on 'other' places. But as a matter of fact "they" are simply "getting away with it" for so long. It is in no way "allowed" or even "legal" at all. They just dangerously make it appear to be and everyone's falling for it now.

You tube is owned by Google - who have an army of lawyers. Nexus doesn't have an army of lawyers. So if we get sued, you get thrown under the bus. As we prefer to not throw our members under the bus to save our own butts, We remove the copyrighted stuff as fast as we find it.

BTW, the way YouTube works is if you upload a copyrighted tune, the copyright owner of the tune claims the rights to your upload, sticks an advertisement on it whether you like it not or not and makes money from your work leaving you out. If they don't like your uploaded video, they just have it taken down. Even if the tune is just a very small part of the video. The big media companies have robo searches running constantly looking for copyright violations and often take down stuff that is not even remotely related to their copyright.

Not all artists agree with the way the copyrights are enforced, but nearly all have contracts with the big media that gives the copyright to the big media.
