Found this Reddit post: Modpack containing 800+ mods which people are now torrenting

Browsing Reddit today I came across this thread:

Apparently some guy has taken it upon himself to create a modpack containing 800+ mods which he's uploaded elsewhere which many people are now torrenting. I doubt he went through the effort of requesting permission from all of the mod authors especially those that explicitly request that you ask for permission.

 

He thinks it's okay because in his words:

I don't feel like sharing his website but you can find it in the comments. I get that he's trying to help the more lazy people mod their game but this isn't fair to the mod authors or Nexusmods where I'm sure 99% of the mods were pulled from.

It appears they finally removed his post. I'm reporting every post I find sharing links to his website. Most people there just couldn't get it through their heads that what he was doing was wrong. One person even compared it to sharing a Spotify playlist!

Not to start a fire here or anything. But the mod creator really has no Copy Rights over anything not even the stuff he crated on his own.

Why ? He never owned anything to start with. The Creation Kit and Skyrim are owned by Bethesda. Anything you create with it or put together with it belongs to them once you post it.

There would be no way to copyright anything without Bethesda being involved. This is the only reason mods can be posted on this site is Bethesda gave the ok to make and post non-profit mods to all.

The rules on the Nexus only apply to the Nexus. No deal was made for any exclusive rights. Though it may be morally wrong it is not illegal to post someone mods as they never had any rights in the 1st place.

I'm sure the rules on the Nexus may include a ban from the site as this is against the rules the Nexus has made. Other then that anyone can post any mods on any site they wish as long as they don't charge for it.

You could how ever charge to be on the site itself or more so for additional privileges on said site. This is what the Nexus itself is. At best the mod creators are only adding to Bethesda works with techniques and content.

I'm sure some of what you see in fallout 4 was actually created 1st by mod makers on Skyrim and added to the game without their consent. Myself, I have made many mods for many games and have indeed seen them take

and add my work to their software without ever contacting me.

NexusComa, you're wrong on every count, but it's 4 PM on a beautiful Friday afternoon and I am SO not up for this argument right now.

Please do a bit of research on this subject, it's been discussed thousands of times here and on other modding forums so it shouldn't be too hard to find the information you need.

And does it even matter if it's legal or not? Is anyone even thinking about going to court for the intelectual property of a mod's content? It's simple a "bad" thing to do, immoral to most people and because of that people report it so that it gets deleted. Its more of a matter of respect (the lack of it actually) to the authors of the work than anything else.

 

I honestly doubt Bethesda ripped skyrim mods to build fallout 4 btw... that's just a very usual thing they wrote in ck's eula that caused a lot of blah blah blah but it's common to most, if not all, modding tools released by game developers. The nvidia modding contest for fallout 4 has similar eula too.

The fact that they retain the right to use as they see fit doesn't mean they are actually going to sell/use people's mods. Most of the time is quicker to just do stuff by yourself than copying it. (specially if you take into consideration how terribly unoptimized and unprofessional most mods are, which bethesda has to)

@Thallassa ...I wasn't looking for an argument. As far as the research part I've been at this my entire adult life. (programming, creating/selling programs, creating mods)

 

@FrankFamily ... I didn't say they ripped mods from Skyrim to build Fallout4. Most programmers don't need to see the exact code to reproduce something they just need to understand the concept.

I totally agree about the "it is a matter of respect". What I meant to get across is legally once you upload a mod created from a games game kit you have no rights over it, as you have just created freeware.

Im not a lawyer at all but, the way i read it, you are granting non exclusive "do with it what you will" kind of permission to bethesda and who bethesda wants to sublicense it to, if any. You are not giving away or loosing ownership of it and certainly you are not giving permission to anyone who wants to use it (freeware), just to bethesda.

And i do agree they may have taken ideas from mods, but since all modders take ideas from other modders and all games from previous games...

Beth has rights to the following, their code, their assets (models textures sound) and their engine. A texture or model or voice clip you create and put into skyrim does not become theirs unless you used parts of their assets, it baffles me that someone on the nexus doesn't know that. they no doubt have a redistribution clause somewhere in their eula to cover their butts if something gets uploaded but you could totally lay a dmca claim against a custom model, some custom scripts, dialogue or noise you made if they reupped it in a DLC.
