Do the permissions state that you may change/alter/modify the file (usually as long as credits are given)? If not, have you contacted the mod author to gain permission?

Best practice is to contact the original creator to ask for their permission. They may prefer to add it as an optional file to their mod page, or they may give permission to upload it yourself. If there's a way that you can make their mod a requirement and not include any of their original files in your download, modified or otherwise, then you can probably get by without specific permission.

Yes, the author has stated in the Permissions and credits tab that creating conversions/patches/translations for their mod is okay as long as credit is provided.

I just ask them. But then again, if you made your own, people would be asking you, instead of the other way around. On that side, just give it away if nobody is paying you to make it. That's what Oblivion was like, yes take it, do what you want with it, thanks. Real nice way to live. Cool post.
