Skyrim faction crime questions...

Hi. I have a couple nagging questions about how Skyrim handles crime, and it's factions.

Example #1;

I've just complete the Thalmor Embassy "Diplomatic Immunity" quest. I was already a

Stormcloak at this point (I was already freeing prisoners from Imperial/Thalmor patrols), and was providing an escort for "Malborn" as he had just risked his life for this mission. On the road back to him apparently running past the Solitude stables, we encountered a Thalmor patrol who immediately went hostile on him. After I intervened, and wiped out the party, I noticed that my assault count had gone up for attacking the very same group faction I had been fighting minutes before. After reloading a save, I reallized that there weren't even hostile to me, though I had done the most damage to their plans, and at the embassy I had killed almost every Thalmor encountered. So basically if I defended someone who was obviously aligned with me against someone who was the exact opposite, I accrued assault charges.

Example #2;

I had already finished the battle for Solitude as the Stormcloak champion warrior. Galmar mentions that I should "know what to do" if I encounter any remnant Imperial encampments, and so on...

After finding several camps, I get the same move along citizen speech variants I always had. And if I had attacked any of the soldiers, I still got assault points on my stats.

One extreme of this was seen while I was visiting Winterhold. A group of Imperial soldiers raids the city, and the guards defend themselves. I naturally jump into the fray, but encounter something odd. AFTER the Imperials are dead, the guards turn, and attack me. At that point if I sheath my weapon, they give me the crime speech for attacking the Imperial soldiers.

So to digress...

Are these faction examples normal, or am I experiencing some kind of game glitching here?

It's normal.If you attack someone that it's not hostile to you, then you will get the bounty for assault(or even for murder).Probably,the Imperial you killed were not hostile to you and you killed them.This is considered murder.

The Thalmor that you killed were not hostile to you,and this is considered murder even for saving Malborn.

To kill someone without getting the bounty,you need to make your enemies attack you first.If this happen, you can kill him normally without getting the bounty, because that will be considered self defense.

Well that's pretty obvious, but not what I was really asking. I could shield bash one of the Thalmor to go hostile, and kill them without murder stats. But... I'd then get an assault, and/or arrested if in range of town guards . In the case of the Imperials, they raid or attack Stormcloak factions on sight. When I, a Stormcloak join in the fight, I get assault or murder charges...? Am I only a honorary Stormcloak without real in-game faction status? Why would my fellow Stormcloak (or Imperial) comrades attack, or arrest me, for doing the exact same thing they just were?

Was this an oversight on Bethesda's part? Or is there something more specific, and cool if it were implemented, like having to wear specific Stormcloak, or Imperial, gear to be recognized as such?

It isn't a crime if nobody sees you do it.

Simply put, you don't have a faction per se and therefore any attack upon non-hostile humanoid is considered a crime.

blame bethesda when they made the skyrim factions they made a mistake they should have made it so the player could could never get a find if attacking/killing an imp if the player is in the stomcloack faction but the game mechanics is screwed and that is why we need to relay on mods to fix their mistakes

If you give yourself the the correct factions then the enemy will always attack you and then no assaults' or murder charges, but then you will always be the enemy to those factions. IE stormcloak walks into solitude and you will be attacked. more realistic but makes the game much different and realistic. This can be done with a patch and new game. But you cant just wear Imperial armor and hide your faction like in FONV, This si why Bethesda made the game the way it is. Factions were lazily done compared to FONV, and you cant do every quest because the factions would block you . If the City of solitude is your enemy how could you be Thane there.
