im having same problem with it staying checked too, hopefully someone has a fix for this
although a couple of you are having a dif problem than me w/ the load loose files box, changing the line in my *.ini file didnt allow me to click on data files option :(
i still have no fix for my particular problem.
If you are still having troubles with the Data Files thing, i just figured out you don't have to change the SkyrimPrefs.ini that's in the game folder, but the one that's in C:\Users\****\Documents\My Games\Skyrim. This ini didn't have the line that you suggested, adding it fixed the problem. thanks too someone else that posted this and it worked for me try it works 100%

I've seen another guy with this problem (unless you're the same person from /v/). My only guess would be something to do with admin privileges. If you're not logged in as an admin, run the launcher as an admin.
K. this didnt change anything. here is a screenshot. you can see that the data files option is greyed out and i cant select it.
i had this problem to you need to go into skyrimprefs.ini the one thats in your games folder not the other one

ok so how do we get the load loose files to load the mods i have in the textures folder are all dds ,how do we get the loose files to run properly without it unticking??

For guys it's not working for, check to make sure there isn't an existing [Launcher] section to the ini as you need to add it to this section if it exists and not create another one.
i had a existing launcher and deleted one but still have a issue with load files it unticks itself when i reload the game its not loading the mods at all

Small problem -- when I did the above, Data Files finally worked. But when I check off "Load Loose Files" and press okay, it gets unselected the next time I click Data Files. If I check it off and run the game, it clearly hasn't worked. Is there an ini value to make it load loose files? I want it to work bad enough that I might reinstall Oblivion (loaded loose files by default IIRC) or Fallout 3 (the loose files option never went unchecked) just to trawl through their ini files and see if they kept the command the same... Couldn't find one in Morrowind, which I still have installed
I'm having the same problem. I tried running the launcher as administrator, thinking that it might not have permission to change whatever it is that it needs to change, but no luck.

I thought the option was available after they released the modding kit, I got Oblivion 2 years after it was released so im just taking a guess.
