Riven1978 Posted February 15, 2011 Share Posted February 15, 2011 Ok I have been getting a lot of questions about a piece of equipment that i had in one of my screenshots, I was helping a friend do up a mod that made it possible to use a certain FO3 mod from ... another site ... in New Vegas. My question is can i legally upload an esp only file that does this to the nexus (no content other then the Esp)? or would that fall under the Illegal side of the house? I am asking in here to prevent myself from any legal issues (least of all being banned from the nexus for it >.<). If the answer is it would be illegal, could some one send me to the right place to look up that information, I enjoy reading Copyright and Trademark. davidlallen Posted February 15, 2011 Share Posted February 15, 2011 There is no problem in uploading content of your own, which requires the user to also have content from somebody else. The problem comes in *including* the content from somebody else without permission. Don't do that, and you will be fine. But, be prepared for many new users to download your mod, overlook or mis-install the prerequisite, and complain that your mod doesn't work. Quetzlsacatanango (do you know that every time i write your name i want to type Quetzalcoatl, I say it right but always start typing that >.<) I have been looking into it and everything says i would be okay to Upload it since it contains no illegal or pirated content, However what you said would be the reason i am posting the question, I want to know what "The Nexus" view on it would be. Davidallen, well the way i would deal with that is the same way i deal with anything else 1.) If you "overlook" the fact that it comes with a prerequisite that is your problem, as it will be written in plain black and white English (easily translatable) that it will require whatever the other one requires to work. 2.) If it is misinstalled (again will be written in Plain (easily translatable) English. As far as contacting the original Author I will be doing that as I always do once i get it packaged up or have something to show them. However, since i am not including their work, permission won't be required, but i always try to notify anyone that i use their work for something. But that (permission) is not really what the question i posted is about. My question was basically where would "The Nexus" stand on the issue if i were to upload it since it itself is not breaking any rules, I am aware of the rules and have gone over them twice now in the past few days and the reason for the question is that they hold a strict anti-piracy policy, well I am not uploading any pirated content so I want to make sure i am reading it correctly before i attempt to upload it. davidlallen Posted February 15, 2011 Share Posted February 15, 2011 There are existing mods on newvegasnexus which are set up the way you propose, so there does not appear to be any issue with the terms of service. If you contact the mod's author and he gives permission, you can create a single mod file for the user to download. This is easier for most users. Riven1978 Posted February 15, 2011 Author Share Posted February 15, 2011 Well for one i am sure that permission to upload anything from their mod will not be allowed, since as it states on the description that it is "Exclusive" for that site. so asking permission is a mute point, since it does come from "That" site i am not sure what is or is not "legal" content, so i figured the simpliest way around this was to use what ever paths they had already set up and just upload the ESP. Your reasoning behind upload it is in my opinion not very sound, it reminds of the old say "well everyone's doing it, so it must be ok" Not always true, just because there are other files similar to the one i propose, doesn't make them any more right then if i were to do it. I am not acting on uploading the Harness ESP without a firm definite yes it is okay to upload... That being said I would really like some input from an Admin or Staff memeber, (will probably send one of them a message later) I may be being overly cautious, but I actually like being on this site and contributing :D Link to comment Share on other sites More sharing options...
