That mod is very much illegal, but Nintendo doesn't know about it. You think the Nintendo devs look at random websites for games that aren't even theirs? Now if someone were to inform Nintendo about that mod, then Nintendo would most definitely be asked to be taken down. If the modder doesn't comply, then there would, undoubtedly, be lawsuits. They only get on you if you distribute it or something like that. Basically, modifications of other series is basically "fanart" It's a loophole, because if they get on you for something like this, then they should make fanart of any sort illegal. The reason why it is tolerated is because there is so much of it around and it doesn't do anything that might hurt future use of that trademark. Some companies even considder fanart as free publicity since it ends up getting more people interested in the base product, and ensures a longer life for the franchise. The company can always request that someone stop making fanart if they believe it to be too close to their product or interferes with a future market. A Pikachu mod would just simply be too close to an existing product created by Nintendo, no matter how you look at it. It's also easier for a company to go after a single person who has crossed a line than a few hundred that just happen to be dancing on the line.
