When you kill an npc shopkeeper, how do the courts of Skyrim decide which family member inherits the business? What are Skyrim's laws on transfer of ownership of property? Is there some kind of Probate Court? And what about child custody laws?

I would assume it simply picks one randomly-for all the pretty graphics and "advanced" systems Skyrim's a simple beast at heart, all games are, and there's a limit to what it can do. This is Oblivion 1.5 with some technical improvements only possible with a major dev-performed revamp, it's not real-life squeezed into a video game. I expect if you kill a shopkeeper the shop will simply shut.

If Im wrong I see potential for a mod of my own-based on Deadly Graduation.

 I was trying to get fonger's attention, lol. I know there's no probate court or any of that.

I'm inclined to think, that in an ancient Norse society like the one in Skyrim, the legal system doesn't get that complicated.

You might be surprised ;-) Law was quite extensive in England circa 1000AD which I imagine was fairly typical of other northern European kingdoms and political domains.

IIRC a family member will take over the shop if you kill the owner and it'll probably be decided in-game already. Edited by Zinro

I think the game will just generate a new character with a preset AI that will say "I was this last shop owner's (sister, uncle, cousin, so on...)" .. That would be the most effective way of keeping the shops from closing when a dragon starts to get the munchies... I highly doubt the game would use in game characters to replace the shopkeeps .. it wouldn't be effective since they could die too and ruin the point.

So like reincarnations of the character you kill? I can see that becoming tiresome, I don't run around killing everything but if a character is a 'tin' then I will crush him/her!! I don't recycle tins I dislike and so don't give me the same person with a different face please!!!?

That seems highly unlikely because the voice acting wouldn't be there to say "I am XXX Smith, cousin errr brother in law errr great uncle to Joe Smith". So most likely it will be using existing characters.
