@Snowsong: No, but the game company in question could say you infringed upon their rights and have you arrested.

 

But they hardly ever do that unless you're actually stealing it. As long as you've paid for it, game companies are usually fine with it. In fact, there's this Gamestop near my house that sold copies of MW2 a couple days before its official release date.

 

Back on topic: No, but on the day of my 18th birthday, the clerk at Best Buy didn't believe I was 18 and wouldn't sell a copy of a game to me (I forgot what it was). I wouldn't have taken the game, but I would have been charged with assault if his manager didn't walk in around the time we were arguing and forced him to sell it to me.

Not if you paid for the game. They can only arrest you if you pirated it. They can't arrest you for something that's not illegal. Now, if you bought a copy and then pasted torrents/pirated versions of it all over the internet, they'll have you arrested.

To be honest, if you turned up at my shop and don't look at least 21 or over, you'd need ID.

The people behind the till don't do it on purpose, we kind of have to.

If a store sold you Skyrim a few days early, the worst that would happen -- assuming Bethesda knew it happened -- was that a company rep would call the store and express his disapproval to the manager. They couldn't even have the manager arrested, much less the person who bought the game. The law just doesn't work like that. The worst that could happen is Bethesda could decide to not allow that store to sell its games any more, which they won't do.
