Confused by the TOS

Bethsoft allows the use of their copyrighted game assets by modders as long as those assets are not used outside of the game they came from. By doing this, they are not relinquishing their copyright rights to their own assets, but are allowing us to use them within certain limits.

So, using an asset that is found only in the Skyrim game - is allowed for use by modders only in mods for the Skyrim game. And assets found only in the Oblivion game are not allowed to be used in mods for Skyrim.

While, In the Fallout:New Vegas game, they did include a lot (not all) of assets from the game Fallout 3 that were not used at all in the game. Those assets that are included, but not used are allowed, but not other FO3 assets that were not included in the NV game.

The reason, as far as we can determine, is that Bethsoft licenses some assets from other third party programmers who own the copyright to those assets. Meaning that Bethsoft could be sued by those third party programmers for allowing their copyrighted assets to be used for modding a different game.

There are some game makers - The people who made The Witcher, and those who made STALKER who DO allow their assets to be used in other games. (Thank you CD Projekt Red and GSC) These assets can be used in mods for Bethesda games as well as others. As long as they are not for commercial use.

The way to get an asset (object or whatever) that you like from another game is to remake that object from scratch - Not copying the meshes or textures, but creating your own, and No , a small change to a mesh is not acceptable any more than a total rip of the mesh.

I hope that makes it a little clearer.
