You'd only legally be allowed to do this for personal use only. Uploading the mod would be illegal and would likely get you banned from the Nexus, and anyone else that helped you.

Ofcourse personal use... Then with those assets remake the whole of tamriel.

In general...

Technically, it's not "legal" to port assets from one game to another (with a couple exceptions), at all, even just "for personal use", though the result is much the same. If you port them, and never ever share them, it's highly unlikely the IP owner will have any issues. In this, you would have to do all of it, alone, with no help (having someone else port something and give it to you to be added to TES5 means it's no longer a personal mod).

However, humans have huge egos. And after spending thousands of man hours remaking portions of a game, could you really not share it with the world?

I can understand how that would be a legal issue since those are technically Bethesda's assets but on the other hand if a person was to use their OWN assets to recreate Morrowind and Cyrodil based off of the old game layouts (not including the storylines and quests, just the landscapes and cities) and make it match Skyrim's time period by altering the world based off of events we know happened in those lands would there be any legal issues there? Because I do remember there being an Elsweyr mod for Oblivion and I believe somebody was in the process of making Morrowind as well before I quit play Oblivion.

If all of the assets used to create this updated portion of the world were completely hand made, it probably wouldn't be thats big a deal for Bethesda. However, the modder needs to make sure that what they do is not exact to what is in a previous game (plopping down a city from Oblivion in the exact same layout/buildings/size would indeed be an issue), make sure things are sufficiently changed around to be considered "derivative work".

But your comment/question is really irrelevant to the OP's question, he's asking about porting assets from TES3 and TES4 into TES5, which is not legal. I can guarantee that remaking Tamriel even with ported assets is not going to be a quick walk in the park, it would take hundreds of hours. If someone wanted to spend that much effort to do something for personal use only, then by all means, knock themselves out. However, the human ego will likely rear it's ugly head at some point.

Lol good luck with that. By the time you ... *maybe* finish tes 6 will be out. This project requires more work than it is worth. The graphics are too far apart and they still are develping morroblivion and aren't done. I suggest u make goals that are more achievable.
