A "merge patch" is for resolving "record level conflicts". The last plugin to touch the record "wins" the conflict. So the winner is determined by the "load order". Which in turn means "yes, you can fix this".

There are basically two ways to build a "merge patch": by algorithm using Wrye Flash's "Bashed Patch" or Mator's "Mator Smash" mechanism; and manually using xEdit (FNVEdit).

The "Bashed Patch" uses "bash tags" to force particular mods occurring earlier in the load order be the winner. Please see the wiki "Bashed Patch file with Marked Mergeables" article for this approach. "Mator Smash" also uses "bash tags", but differently: as a means of "grouping" records, and should be used in conjunction with "Merged Plugin Standalone". Both methods are discussed in the wiki "Merged Plugin Guidelines for Personal Use" article.

With xEdit you can manually drag the desired winning record into the "patch file" you are creating to force it as the winner. This can be done with a "Bashed/Smashed Patch" file as well to create an "override" file (that forces a particular record winner) and goes after the patch file. (It does not use the patch file as a "master".)

And then there is the "terminology" question. People easily confuse a "merge patch" with a "merge plugin". The two are very different beasts.

All of this is covered in much more detail in the wiki "Merged Plugin Guidelines for Personal Use" article. Suggest you read that before attempting any "fix".
