That's great and all, but it is still illegal as those people are using Bethsoft's models and textures without permission (they would never give permission). Those who are making that project will either be shut down, or sued. And since this is labeled as "a modding project" it'll only end up hurting the modding community even more. As thrilled as you may be about it, any such feeling is very poorly placed since these sorts of things will only lead to further restrictions of future games (death of TES modding). When that happens, you can thank idiots like them for ruining things. This is the worst idea ever, and NOBODY with any understanding of the world would be thrilled about this. It is THEFT plain and simple, and this will NOT end well for anyone.

Will Oblivion be a different game tho? don't all other mods use oblivion resources somehow? From what I know, this should just be like Morrowind graphics extended, the graphic engine is modified and wouldn't that be about it?

Except it isn't just making minor improvements to the existing engine for a game. It is taking resources from one game and putting them into an unrelated engine. It is also being done without the permission of the company who owns the rights to those resources, and the world, for use in a product which does not require the original software to be in use. MGE still requires that people use the actual Morrowind game. This is just a rebuilding of the TES world. There is nothing similar between them.

 

As for Morroblivion, that is a sore subject on both sides, largely due to how poorly it was handled by both parties. It was never legal to use it because it ended up converting things for one game to be used in another. This was a problem since Bethsoft didn't own exclusive rights over all the work which was present in Morrowind, and could not release their usage within Oblivion. Those things within Oblivion are only liscensed for use within Oblivion. Essentially, it's like asking permission to use someone's artwork in one of your mods, and then someone who uses your mod to make their own mod, without asking for permission to use that artwork from the original author (since you don't have the right to release usage of that artwork yourself as you were just using it yourself). It's a complicated legal thing that most can't seem to understand, or care about.

 

Regardless, encouraging stuff like this isn't good for anyone.

No, probably not. All you see are imported statics which have been arranged. Not any of the game mechanics or AI behavior. Such things probably wouldn't convert very well, and at best, this project could just be a FPS setup with Oblivion environments. Not a landmark, kinda unoriginal really. And given that most of the statics being used are the IC ones, and are essentially, large pieces which are made to fit together, it isn't really that great of a feat. The only part which is actually striking are those things which are related specifically to the engine (grass, trees, water), and were not anything that those people really did.

-be careful with your words plz... even so it might be illegal in some way to release such a project... by german law (which applies as i see it since its being done in germany) "theft" is taking something away from someone in a way that he'll loose the ability to use the item as he did - does not apply, ist a copyright infringement if anything... also by german law it would NOT be a "crime" as a crime is defined there by getting sentenced for at least 1 year in prison - its more of an offence for the lack of a better english term... which is most unlikely as they did not intend to commercially use their product (even then it would be unlikely)

-but calling someone a thief who isnt is quite a delict by german law and afaik also in us law :P

 

apart from that i see all that licencing stuff as quite dangerous as we can see at the subject of gm engineering... make some species xtinct and licence their dna... just as one example... or take all the musicians who claim the right to a song even tho a guy 100 yrs back invented it and never got a penny for it... there is just too much wrong with the whole licencing laws...

whats the bloody problem if someone takes your stuff, makes it better (or worse) and gives it to the people? as long as he doesnt make money or gains an advantage over me with what i produced i give a crap!

and a mod definately wont harm my buisiness as a game company lol how awkward it might be...
