Skyrim Metroid sound mod

So I contacted nintendo about using the music from the metroid series (Metroid Prime, Metroid Prime 2: echos, and Metroid Prime 3: corruption)and replacing the skyrim music with it.

 

And this is what they replied with...

 

Thanks for writing. Nintendo publishes the Metroid Prime games, so it is not necessary to contact Retro Studios. We are always flattered when we receive requests to use the music or other properties from our games. To us, this is a sign of success the and recognition of the Nintendo brand.

 

As you can imagine, we receive thousands of requests similar to yours and do not have adequate staffing to review them all. Therefore, our general policy is to decline all such requests, no exceptions. I realize this isn't what you wanted to hear and thank you for understanding.

 

Although we are unable to grant permission, use of Nintendo properties without our formal permission may still be allowed depending on the circumstances. You are encouraged to seek your own legal counsel if you have any questions about whether your particular proposed use is permitted without Nintendo's authorization. This is not a comment on whether we believe your particular proposed use is permissible-Nintendo cannot provide legal advice.

 

 

So would I be able to do the mod or not.

This is mainly for nexus staff but anyone can reply.

I think that there would be a problem if you were making money off of Nintendo's trademarks. If you're not profiting from it then I don't see why they would have a reason to sue you. Even if either way they would have a huge legal case against you.

So, no. You aren't allowed to use it in mod.
