I've heard conflicting reports on this, and have never really gotten a straight answer on it. Do non-activated esps in the data folder count against the esp limit?

No. But I have heard (or rather read) some modders say that even though they are not active, it is better to uninstall them if you no longer use them.

A trick I use to clean up my data file is to create a subfolder in data and name it unused esps. The name doesn't matter as long as you know what it is. Then move any esp that I don't use into it. that effectively takes the mod out of the data list while allowing me to easily put it back in if I want it later. I only move the esp, not any of the texture, mesh or other files.

I've read some things that say even though non-activated esps don't count against the limit, they can lag your game because oblivion constantly run checks on your data folder while playing, so that sounds like a good idea.
