Asset rules/legality Question

I'm curious if using asset parts from the unity store as published mods is allowed/legal on the site. I've already got them added to my game and have the legal rights to use them as such, but am curious as if they are allowed to be posted here.

did that mod give you permission to re-upload its assets

 

the usual way to get around this is to make it known that your mod requires these assets

 

and post a link to the other mod

We have no way of knowing without reading the licensing for that particular asset.

 the problem I'm having is I'm not seeing any licensing terms anywhere? There's the unity store licensing here (https://unity3d.com/legal/as_terms) but upon downloading and such there doesn't seem to be a user agreement aside from the general unity thing, ( there's nothing packed in with the assets )

I would guess that it's ok to publish a mod using that, but you might want to report the thread to the Nexus staff moderators for their official approval.

The relevant paragraphs seem to be:
 

2.2.1 Non-Restricted Assets. The following concerns only Assets that are not Restricted Assets:

Licensor grants to the END-USER a non-exclusive, worldwide, and perpetual license to the Asset to integrate Assets only as incorporated and embedded components of electronic games and interactive media and distribute such electronic game and interactive media. Except for game services software development kits (“Services SDKs”), END-USERS may modify Assets. END-USER may otherwise not reproduce, distribute, sublicense, rent, lease or lend the Assets. It is emphasized that the END-USERS shall not be entitled to distribute or transfer in any way (including, without, limitation by way of sublicense) the Assets in any other way than as integrated components of electronic games and interactive media. Without limitation of the foregoing it is emphasized that END-USER shall not be entitled to share the costs related to purchasing an Asset and then let any third party that has contributed to such purchase use such Asset (forum pooling).

2.2.2 Restricted Assets. The following concerns only Restricted Assets:

Licensor grants to the END-USER a limited, non-exclusive, worldwide license to the Asset for personal and non-commercial use; no other use is licensed or permitted. Except for Services SDKs, END-USERS may modify Assets. END-USER may otherwise not reproduce, distribute, sublicense, rent, lease or lend the Assets. Without limitation of the foregoing it is emphasized that END-USER shall not be entitled to share the costs related to purchasing an Asset and then let any third party that has contributed to such purchase use such Asset (forum pooling).

In my experience, this is what it appears to be saying.

 

If you're the one (the "Licensor") who bought the package, then you can use it for personal and non-comm use, so long as your use is "integrated" with a computer game or interactive media project.  That means that Unity expects that the asset can't easily be separated from the whole.  If it was a simple matter of "you bought it, feel free to redistribute it for noncommercial projects", all the rest of this legalese would be unnecessary.  They're explicitly saying that is NOT the case.

 

The problem with loading it onto Nexus is that it ISN'T integrated.  The assets, in fact, are quite easy to extract, and many people will do so.  While you MIGHT have some legal wiggle room to distribute your own mod with those assets, under fairly limited conditions, no one else could likewise redistribute it legally.

 

I would say that it's a no-go.  There's enough legal ass covering in that EULA to clearly conclude that any argument in favor of redistribution in a public mod is just splitting hairs.  They clearly don't want you to do it.

ah, oh well. Thanks for the replies. I suppose the nexus distribution part is really what kills it.
