I solved this by giving 200 personality and speechcraft to my horse, so everybody in the world has 100 confidence with him and don't attack him.This is a real bug. Normally a bandit kill the traveler to steal the horse. In Oblivion they want to kill you and your horse, and if a bandit kills you (but it's really hard!), he/she don't chek your corpse . I usually just try to outrun the enemy on my horse, 5k is a bit too much for my low level character to dish out again for another black horse. I think there are a number of mods out there that address this same issue already, but again, not sure. Also, I've got the Chestnut Unicorn mod running, and they still go after the horse. Why didn't Bethesda even bother to fix this? Are they stupid?
