We need to work on this: Part 2

That's right, it's this thread again.

Before I start, note the topic description. By now most folks know that I do not mind the imageshare rules. I am, however, very concerned on the way they are enforced.

Also, DO NOT bother replying to this thread unless you know exactly what it's about. The last thing I need is someone whining about a subject that this thread is clearly not about. Read before posting.

I would like to remind everyone what is and is not against the rules.

Quoted from the Term of Service:

“No nudity” includes boobs and genitalia as well as visible pubic hair in the genitalia area.

Quoted from Vagrant0 in the Clarification and expansion on Image Share rule changes thread:

What is not allowed ANYWHERE in the non-supporter image share:

Exposed female breasts (including nipple and aureole)

Pubic hair (shaven or non) or exposed pubic region

Penises

Testicles

Vaginal area including Labia, Urethra, and Clitoris

Anus

Graphic depictions of sexual acts

Transparent clothing which covers the above areas, but still allows them to be seen.

What is allowed, but MUST be tagged as Adult (NSFW):

Any and ALL gore or depictions of violence

Visible cleavage

Visible buttocks (one or both)

Sexual themes (such as bondage)

Transparent clothing or layers which covers the above areas, but still allows them to be seen.

On several occasions over a very short period of time users have been banned due to "imageshare nudity," with the most recent one in question being Mercury11. I know Mercury well enough to know she would not blatantly break this rule, so I got in contact with her and was able to view the picture that was reported.

Let me paint a picture for you: there was a bare back, a bum, and about nine pixels worth of a very shadowed sideboob. This picture did have a flag. She wasn't banned for not flagging an image, she was banned for nudity.

Let's see what things this picture had in it:

What is not allowed ANYWHERE in the non-supporter image share:

Exposed female breasts (including nipple and aureole)

Pubic hair (shaven or non) or exposed pubic region

Penises

Testicles

Vaginal area including Labia, Urethra, and Clitoris

Anus

Graphic depictions of sexual acts

Transparent clothing which covers the above areas, but still allows them to be seen.

What is allowed, but MUST be tagged as Adult (NSFW):

Any and ALL gore or depictions of violence

Visible cleavage

Visible buttocks (one or both)

Sexual themes (such as bondage)

Transparent clothing or layers which covers the above areas, but still allows them to be seen.

In short, she was banned after completely following the rules. Yes, it says "No Nudity," but the full rules are written above. Implied nudity with a flag, should never, EVER be a bannable offense.

I firmly believe some of the moderators here may have a less-than-firm grasp on what is and is not allowed. Please fix that. And please reinstate any individual that has been banned for following the rules that have been put in place.

--------

Now, I would like to touch upon the rules and perhaps polish them a bit.

>Exposed female breasts (including nipple and aureole.) One can attempt argue the subjectivity of the term "exposed." For now, let's say change the word "including" to "specifically;" as in "Exposed female breasts (specifically nipple and aureole.)"

>Visible cleavage. This is a little too open-ended. If that was the case, then almost every picture ever posted ever would need an adult flag. At that point, an adult flag would be rendered redundant, as anywhere around 70% of the imageshare would be marked adult. Instead, let us simply assume "visible cleavage" implies "over 40% of the breast area is visible. Underboob will probably need a flag as well.

>Also, I would like to add to it. This is for the flagging section: As a general rule of thumb, if your character is wearing less clothes that the default underweared character, flag it. If your character has underwear visible, flag it. This prevents people from bending the rules and posting shots of barely clothed characters or upskirts, crotch shots, etc.

So, with that being said, these would be the slightly revised rules:

What is not allowed ANYWHERE in the non-supporter image share:

Exposed female breasts (specifically nipple and aureole)

Genetalia, including penises, testicles, vaginal area, or anus

Pubic hair (shaven or non) or exposed pubic region

Graphic depictions of sexual acts

Transparent clothing which covers the above areas, but still allows them to be seen.

What is allowed, but MUST be tagged as Adult (NSFW):

Any and ALL gore or depictions of violence

Visible cleavage (40% or more of the breast area is visible, nipple and aureole remains hidden)

Visible buttocks (one or both)

Sexual themes (such as bondage)

Transparent clothing or layers which covers the above areas, but still allows them to be seen.

Significant amount of skin and/or underwear is visible

I look forward to hearing thoughts on both topic. The important one is on top though. The second one is simply a few suggestions.

In closing, I will remind you of what this thread is intending to fix: the fact that users should not be punished for following the rules.

This smells like a petition to get somebody unbanned. This is a subject to be taken up with the moderator that did the banning or Dark0ne in a "PRIVATE" message...not a public spectacle which is against the Terms of Service:

These moderators have a right to carry out their task without harassment, insult or hassle. Members who believe that a member of staff is not conducting themselves properly should get in contact with Robin via the forums or email. Know that if Robin receives word of any members harassing or being rude to Nexus site staff then he will take every action possible to permanently remove them from his sites.

I also just noticed when looking up the above text that it was AlienSlof that banned Mercury11 which is quite funny to me. Out of all the staff on the Nexus, AlienSlof has the most liberal view on such matters. You really need to speak with the AlienSlof or Dark0ne. Please do not repeat this public spectacle or you will find yourself sitting with Mercury11.
