While they offer means to download songs for free from their site, they also sell the songs through iTunes.

Regardless, you will definitely need to ask for their permission to re-distribute their recordings in a Skyrim mod available for free, as it's their copyright protected property.

 

So either nobody deemed it worthy to investigate whether they'd give permission or not (maybe even language barrier issues, looking at the language of the iTunes page they link to),

or they simply said "no" to all requests so far, and that's why.

 

You can't just put music you found on YouTube into a mod whenever you feel like it. When those artists find their stolen properties on sites like this one later, their lawyers will be very happy.

if you can legally obtain a copy either paying for it or for free, you can use it in your own personal mod. But to distribute it to others you would need permission.

Nexus policy is you can do whatever you want as long as it is only on your own computer. We really don't care. However, When you make it available for other people to use through the internet ( or any other means) that is called distributing it. And distribution is subject to copyright laws. Those Laws can be enforced through law suits. The Nexus is not interested in defending itself from rabid copyright lawyers determined to sue us out of business because of some user deciding they absolutely must upload some copyrighted material for everyone else to use. So, we just ban copyright violators whenever they upload stuff without documented permission. :yes:
