Music License Question

OK, I have an overly specific question regarding a very specific song from a game that I want to use in my mod. I want to use this song...

 

Homefront: Golden Gate Bridge

 

In a mod which will come out later on down the road after "The Lost Legion." Who do I talk to, or pay to use it? I could use some royalty free stuff... but... let's just say that it would greatly detract from the experience. I ask this because... I'm pretty sure that I can't just "Use It." I mean, we can't even legally port some of the music from Fallout 3 into New Vegas for a mod so why would this be legal? :pinch:

I don't think this falls under Fair Use, no. Which is a shame.

 

However, you could get someone to re-record that song onto an original file, then use that. I'm pretty sure that in that case, you're just using their IP, which is covered under the EULA.

 

The trouble will be finding people with musical talent, of course.

They must mean get some musicians to record a cover version of the song, which is closer to a legal grey area but still prohibited (bands still have to pay for the privileged of recording and distributing covers of other people's music). Which might get your file pulled if you uploaded it to the Nexus. You'd probably be safe if it was a cover of something already in NV but using someone elses cover of a song from a different game that you don't have permission for is pretty much the same issue as using other content from a different game that you don't have perms to use.

 

Before you go through the trouble of finding a band that's willing and able to create an interesting cover of the song, I would suggest first speaking with a member of staff about the actual feasibility of using a cover.
