Would I be banned if I uploaded it? You can only use royalty free music. You can also ask the author of the music for permission to use it. Be very clear for what you would use it, will you make money out of it etc. If you do get a official answer, include it with the mod. There is a mod called immersive music. The author from that one actually contacted cd project red, brunuhville and vindswept to ask for permission and included the replies in the mod. He might be a good example of how it should be done. And yes.
