ginnyfizz
Looks like the same applies to Sony users in the UK and EU as it does to Windows/Xbox Live users, they knew from the get go that they could not get a waiver of the right to class actions past our consumer protection laws. I hope that whoever is taking the action in the US points out the fact that these ludicrous restrictions in EULA's are already regarded as unenforceable in much of the rest of the world! Beriallord
Will they afford someone a full and unconditional refund should they not agree to the EULA terms? I think they should have to if they subject people to such terms. Basically under no uncertain terms they are saying, you forfeit all of your consumer rights, and they reserve the right to modify the software at any given time via updates and do anything they want, and add/remove any feature they want, even if it was a feature they marketed as a selling point for the system. The other OS feature for the PS3 was a great feature, and gave it a clear edge over the 360 as far as utility goes, and they completely removed it just because it might make it easier for people to play pirated games on the system. I hate Sony, I hope they go bankrupt.
Thor.
This is very welcome news. I don't use the Sony network in any way so cannot comment on their EULA. I did notice that, some weeks ago when another member on here (who was from the US) urged us all to take a look at the new Microsoft Live/XBox EULA before agreeing, the reference he specifically mentioned preventing class action lawsuits was noticeable by its' absence from the EULA presented to Microsoft European users, this presumably being because consumer protection laws in the EU would strike down such a provision. If someone in the US has decided that such protection should be afforded to their users, then all power to them. Can any European Sony network users comment on whether or not the European version of their EULA does contain the same attempt to restrict class actions? http://legaldoc.dl.p...e_tosua_en.html I can't see anything. Its Probably because in the UK Sony can't get away with it, try looking up the USA and Canada Policy of the EULA. Edited December 30, 2011 by Thor.
