The modder must actually do something with the files,n ot just repackage them and claim he's done it. There's clear rules here against that.

Ok, in that case, can you please point us to where these clear rules are defined?

I am looking at the EULA now, and i can't say i see it there (that being said, my understanding of english language is rather limited, so i might be prone to misinterpret things).

 

EDIT: Oh, sorry, i just noticed - you wrote "There's clear rules here against that" - you mean "here" on Nexus? Well, if that is the case, then ok, that i understand.

I thought that Bethesda might have some rules against it.

Bethesda won't allow that either. It's basically piracy.

Thing is, i have many mods where i am using various Bethesda's files unedited - for example, some materials or textures which i had to rename or move in order to make some material swaps work correctly. It is only a coincidence that i am using those mods only for my personal benefit and did not released them, but if i would want to release such mods, are you telling me it would be illegal? it would be piracy?

I dont mean to argue about this, i just want to know how it is, because i might want to release these mods in the near future, and with respect i dont feel like i can just take your word for it - i'd like to see where is this forbidden.

The way you word it, would make virtually any modding impossible.

Naaa, this can't be piracy as modding the original textures would also be piracy as you use the original content, modify and repack it.

With your comparison every cosmetic mod on nexus is basically piracy as the original files were extracted, modified and repacked.

 

As this DLC will be (as in Skyrim) non-payed content it could not be a problem to give users the possibility to chose which optimization the want in the end instead of being forced to take it or leave it...

I guess an alternative would be to have a mod that lets you choose which textures you want and which ones you don't - and simply have it delete the already installed texture files and keep the ones you've chosen. Much like Ethreon pointed out, this can be done by simply unpacking the BA2 files and choosing which ones to keep. This would work and (I'm fairly certain) would be perfectly okay to put on the nexus.

Take game file and use in combination with various other assets you made - mod.

Take game file and just publish it as is without changing or adding it to custom made assets - not mod. Not allowed either. But hey, please do go and publish those textures the way you think it's not against the rules and see how long it lasts.

Bethesda has legally given permission to modders to modify the game and its assets as long as we do not accept ask for money for it. But re-distributing assets without modification is considered piracy. There is a difference and it's a simple one.
