External non-profit download links related to subject matter- Allowed?

I'm not sure where you stand with dialogue but the copyright on a song/tune doesn't change because someone else sings/plays it.

 

Nope, it doesn't. The point is, I'm getting told if that if someone links to copyrighted content here, they are getting insta-banned. And yet communities like these could not exist if members could not create derivative works based on copyrighted works by the developers of Skyrim/ other games dealt with here.

 

For example, how can a mod to improve dialogue/ in-game music be made, while still keeping with the ambient of the game, if a modder is not allowed to use terms "i.e Dragonborn", or tunes that belong to the devs/publishers?

 

I'm aware that if the devs feel someone is crossing the line as regards fan-made content, they are going to swing into action against them. (I have no intention of doing this :P)

 

But that is a distinct matter from what a user is allowed to do on these forums right? All I want to know is that The Nexus will not take action against me for generating fan content based on copyrighted material for the game this forum is about, exclusively for non-commercial purposes, and posting links to such content here, from my site.

The insta-bans have been for linking to content being used without permission.

 

I think we've established that Bethesda have given their permission for this sort of use, (as long as any mod uses only assets from the game for which it's made. They do not allow porting of assets from one game into any other.)

 

So as you said, it's really up to the authors/creators/copyright holders. Here at the Nexus we simply try to enforce whatever usage restrictions they choose, with a default presumption of "No use without explicit authorization." :thumbsup:

I didn't read the entire thread but if this helps; "fan made" content in regards to music is called a cover and is perfectly legal as long as you contact the owner and get permission or pay them. For example I could sell a CD with me playing a Beatles song but I would have to pay a fee for each cd I sold. Allowing downloads from a web site has a similar requirement. So there is a legal and fair way to go about use and distro of other people's copyrighted work.
