I suspect I already know the answer to this, but I'll ask anyway.

 

I want to upload an updated version of Ruins of Miscarcand (http://oblivion.nexusmods.com/mods/24471). I tried contacting the author, but he hasn't responded after 30 days, and he hasn't been active on the Nexus for almost 6 months. His readme says that "Everything else is made by me and totally free to use. I don't care if you credit me or not." which obviously applies to the meshes and textures, but I'm not sure about the esp (and I'd credit him anyway :) ).

 

So... is it okay to do it?

Well he did say "totally free to use" so I don't see why you can't use the esp, as long as you give credit to Sachiel if you use his rock resource. There should be no problem.

 

Note: I'm not a mod or anything so I could be wrong.

All files uploaded must have been created by the uploader or used with permission from the original author of the content. If you cannot provide proof of consent when asked then your file will be removed and your account is likely to be banned.

 

ALWAYS CREDIT WORK THAT ISN'T YOURS

If you have received permission to use someone elses assets in your files you should always credit them. If you don't credit assets you've used from other users you will be considered a thief and you're likely to be banned; so it's very important you credit the work of others that you have used.

 

Note: crediting other people's work does not entitle you to use their work. You must always get permission from the creator of the work first before you upload it to the site.

I would add the update as a patch file, requiring the original download for the meshes and textures. This way the original mod still gets downloads, while releasing the fix you wish. I think that almost any author would accept that method. Even if your esp file does completely replace the old one, requiring resources from the original file will ensure people still use the original download.

 

I would also pm the author to inform him/her that the update has been posted. I personally would offer the option of allowing them to use my updated esp for their download, provided credit is given to the update author as well.

 

All in all, if they said that the file is ok to use, I would use it. Requiring the original will ensure you took all the proper steps.
