Legality of creating quests using lore from other games?

Suppose I wanted to make a quest mod, using characters, lore and direct references from another game, say Dragon Age for an example.

Also I would like to recreate areas, and adapt existing Skyrim meshes to create ones based on DA using the CK.

 

Assuming that no actual assets (meshes, textures, and the like) are being ported from DA to Skyrim (besides the characters and lore) is this hypothetical mod ok to upload here?

Chances to get problems is pretty low, especially when you create your own stuff and call it "inspired by blabla" and dpn't use original names BUT the bigger the project the bigger the risk - so if you're planning something really huge i would recommend to ask for permission. Otherwise it might be a waste of time (like the MERP project using Lord of the Rings content and got busted) - to be on the safe side. Edited by ghosu

Well I'm not going to make any MERP scale projects by myself any time soon, but thanks for the clarification.

As long as you are not making any money off it, you can do whatever you want, it is the freedom of expression and freedom of speech last I checked, As long as you are not making a profit is where you have an issue.

That's not actually true. The MERP people aren't making their mod commercially but still got a cease and desist notice because they are competing with the official LotR games. Basically, as long as you aren't making profit OR cutting into the profit of the people who own the rights, you're on pretty safe ground... but the people who own it can say basically anything is cutting into their profits and offering competition, and if you directly import from the other game then you're in the wrong, technically. It is much safer to change things and be "inspired by", like Ghosu said.

 

Of course, if it's a game that's ten years old and wasn't really ever a blockbuster, you're pretty safe no matter what. (For instance, I'd like to recreate Might & Magic VII ^-^) Much less chance of being threatened with legal action if you're not working with anything current and popular.
