Even if you imported the model and made extensive changes, you still imported that model and are using pieces of it for insertion into another game. Creating models from scratch based on the designs from other games is usually OK and falls under fan art. Keep in mind that some companies do not even like the existence of fan art if they think it infringes on their IP. A good example is pretty-much anything related to what the BBC creates. I have asked for permission to create an armor set based on their robot but was given a cold "no go." I "could" go ahead an create a model and release it but I'd rather not put my time and energy into something if the original creators / IP holders are going to be difficult. You can make it look identical and it still falls under fan art so long as it is not actually identical...meaning you used their meshes and textures. Some corporations seem to be trying to make it so but so far 'inspiration' isn't a copyright infringement. I AM NOT ENDORSING COPYRIGHT PIRACY!!! As FEAR means First Encounter Assault Recon then try to find just as good a sounding acronym to build your own models from. Also there are those such as SWAT that nobody can copyright though they might try (unless I have this wrong) because it is a long used public (historical) term. SWAT is in some ways a much better term than FEAR anyway and makes more sense in a Fallout 3 game, especially if the SWAT unit is using 'special weapons and tactics' to deal with 'special threats' like super mutants, raiders or the Enclave. I AM NOT ENDORSING COPYRIGHT PIRACY!!! The copyright scene seems to be getting more monopolistic and unfair every year but there are still plenty of ways to work around it by not directly eluding to any copyrighted terms. A group of Doctor Who fans made their own shows based on Doctor Who quite legally by simply not having any copyrightable terms used such as 'TARDIS' or even directly eluding to certain copyrighted concepts. The BBC turned a blind eye to it! I AM NOT ENDORSING COPYRIGHT PIRACY!!! As for asking permission of corporations about copyright, they are often legally obliged to say 'no' even if in truth they don't give a damn. I personally know (can not give details) of at least one incident in which a corporation didn't care about unintentional pirated copying of material as long as it was not officially notified of what was happening and it is a big corporation. Often it will cost a corporation far too much money to go after what it sees as little people and even if it does (another situation I was involved with which involved a big American corporation of much fame) it might be fairly slow in getting around to doing anything and then only give a nasty sounding warning. Only a couple of corporations seem to be copyright imperialists, hunting down everybody that even strongly hints at infringing their copyright. Ironically these same corporations are often (but not always) the biggest thieves of other people's ideas. I AM NOT ENDORSING COPYRIGHT PIRACY!!! My main point is that I think it is better to use copyrighted work as an inspiration rather than using copyrighted terms.
