axonis
1) What about mods that were uploaded before you changed the ToS a few years ago ? Do you feel they are still bound to your new ToS and that they cannot be deleted by request of their creators, despite the original agreement ? 2) Your new ToS state that if users don't agree to them, they must delete their account. Does that mean their content is also deleted ? If not, what exactly does deleting an account achieve ? Edited November 4, 2021 by axonis
Dark0ne
1) What about mods that were uploaded before you changed the ToS a few years ago ? Do you feel they are still bound to your new ToS and that they cannot be deleted by request of their creators, despite the original agreement ? Our solicitor is firm that irrespective, we have the legal right to retain those files based on the old ToS, let alone the new ToS. However, if a user deletes their account without using the site since the ToS change and asks for their files to be fully deleted (they will need to email [email protected] to do this) then we are more than happy to action their request as a once off. Continuing to use the site since the new ToS was put in place is an acknowledgement of our terms and any licenses given through them for any files on Nexus Mods; past, present or future. People who do not agree must delete their account through the user service (linked in the Terms and Conditions) without using any other part of the site. I believe this also answers your second question. Deleting your account removes your account and it's personal data. It does not remove any uploaded content that was already licensed to us. We are offering the above on goodwill alone and not from any legal need to.
