Items in Skyrim can be owned by a variety of different NPCs, even in the same location. Sometimes, they don't have an owner aside from the game itself, other times, their owner can be anybody that uses that building. I believe that's the case, anyways, I remember testing raising disposition with the guy who had the golden claw, but still only being able to take some things due to his sister owning them.

It's slightly more complicated than that because factions can also own stuff, and in particular the store is controlled by the faction rather than a specific actor. There are at least a few instances where the store cell is clearly assigned to a faction rather than an individual (Warmaiden's, the apothecary in Riften) because the same store is opened by two individuals.

 

There are Papyrus functions for GetActorOwner and GetFactionOwner, but similar functions in Oblivion did not register the correct owner if the object inherited its ownership from the cell. There are similar functions for cells, though.

 

The problem is that if the faction owns the cell rather than the actor, I'm not sure how to figure out whose vendor window to open.

Of note: If this mod is made, and the player attempts to purchase an item that isn't the "type" that the owner sells (For example, at a tavern, trying to buy a plate), then the shop won't actually show it on the list of saleables, since the item would not have shown up on the list, anyways. Basically a big empty inventory gets shown, as a big fat "Screw you, that's not for sale."

I have an idea for how to do this immersively (and practically):

If you are sneaking and hidden as you take an owned item, it's automatically theft.

If you are sneaking but you're caught taking an owned item, you're automatically reported to the guards/attacked by the owner.

If you are standing and take an item while the owner sees you, the owner approaches you and asks if you wish to purchase the item(s). You are then given the option to pay for it, hand it over to them, or refuse to do either (openly stealing).

If the item is not for sale, the owner may not offer a price and would require you to hand it over.
