Information Regarding Mods That Can Be Found Both On Nexus and As Paid Content on Steam Workshop.

Given the title of this thread I think it's irresponsible to list mods like SkyUI that are still freely available on the Nexus.

 

For SkyUI nothing has been removed (or will be removed) from Nexus. Version 5 is being released on the Workshop, version 4.1 is still where it has always been. I'm also expecting a version 4.2 released to the Nexus with some bug fixes although not until the community cools down a bit and stops acting like an angry rioting mob.

 

After looking at the list more carefully you should get one of the moderators to rename this thread because the vast majority of mods on the list don't meet the criteria of the thread title.

Yup, I forgot about the title. I have listed information clarifying as a general statement for people to read. If a mod is on the list, I have made is expressly clear if it an be found on Nexus for free, what its status is, and, If I know, whether it will be updated etc.,

Unfortunately many people won't actually read more than the title and the names of the mods which is why I suggest a name change for the thread. :smile:

I have contacted an admin requesting a title change. Thanks for bringing that up. I hope people at least read the information that follows the reddened mod title, as I am attempting to contact mod authors for information regarding updates and so forth.

I'm not a lawyer myself or anything, but this is vastly more complex then what folks realize, and you'd need to talk not just with a lawyer, but one that specializes in this field of law. Even they may not fully know the outcome of how this is going to play out.

When you make any original work, it is by default copyrighted. I know this because I work in software development, and I do not have to apply for any legal copyright to receive all the same protections as any large corporation that is similarly making their own original works. If I grant you permission to use my work as a basis to build your work upon, but I do not give you express license to resell that work, your already getting into a shady area.

Thanks to the big media and software companies, and their anti-piracy lobbying (ironically including Steam and Bethesda themselves); they, as well as any mod'der using work containing anothers, may not only be open for civil penalties, but also criminal ones.

Software theft is a serious matter. If you or your company get caught copying software, you may be held liable under both civil and criminal law.

If the copyright owner brings a civil action against you, the owner can seek to stop you from using its software immediately and can also request monetary damages. The copyright owner may then choose between actual damages, which include the amount it has lost because of your infringement as well as any profits attributable to the infringement, or statutory damages, which can be as much as $150,000 for each program copied.
In addition, the government can criminally prosecute you for copyright infringement. If convicted, you can be fined up to $250,000, sentenced to jail for up to five years, or both.


Right now, because there were others original works that may be contained in mods that people claimed as their own original work, then attempted to resell, all parties involved in profiting from those works that were used without permission may be both criminally and civilly liable. Just because Bethesda claims that someones mods are made using their software, does not give them any rights of control over a script that I wrote in notepad, or a model I built in blender. In the same manner, just because Steam claims ownership of any mod uploaded to their site, that does not include third party content that may have been used in the creation of that mod, and uploaded to steam, without the original owners permission.

Right now, if I had been one of the folks who created a mod, that was used within another mod, which was subsequently put for sale on steam without my express permission, I'd be on the phone with the states attorneys office, the state computer crime center, or as it crosses state boarders possibly even the FBI, for filing piracy charges.

You don't have to hire an attorney and go through a lot of legal expense since what these guys have done may well be theft of intellectual property. They may very well be criminally charged, and if that happens, civil litigation is pretty much an open and closed deal. As a matter of fact, they would most likely just settle.

If I were a mod that was considering placing something for sale on steam, and it had anything that could even be construed as having been based on other peoples work, I wouldn't do it... Regardless of how much steam or Bethesda's lawyers claim its all legally on the 'up and up'.

Thank you for this list. I will be avoiding all of these authors, except for SkyUI which there is no alternative to at the moment. Should anyone make an alternative, I'll be all over that.

Check out the update to SkyUI. The author was kind enough to explain what would be happening with updates to SkyUI in the free and paid versions.
