I would like to know why my mod was banned

I have been on here for years. I have seen a slot of mods. Made a few yself. This time I made a mod using 32 second sound clips from:

I can not use those? But people can use The Last of US? Or people can use full length Audio tracks by actual classic artists?

 

Yet mine gets banned for copyright? Im not all that upset, not going to be my "big mod" I have planned. But I am rather confused and upset at the time I spent into putting it all together.

No, they cannot - any files including copyright materials used without permission from the copyright holder is not allowed.

 

 

  • Absolutely no copyrighted work is to be used without permission of the original creator. This includes content from other games, from DLCs, music creators or from other file authors. This also includes members from countries that do not recognise copyright laws.
  • All files uploaded must have been created by the uploader or used with permission from the original author of the content. Such permission must be indicated in the Readme text attached to the file and/or on the Description page (or in the Description field for images), and must be obtained in advance, before uploading the file. If you cannot provide proof of consent then your file will be removed and your account is likely to be banned.
  • Always provide appropriate credit to authors who have given you permission to use their content in your files both within the file description and within your file readme, even if said content was published as free to use.

 

Just because you see something uploaded does not mean it was allowed, it just means that we have not been notified of it yet.

The "others are doing it" excuse

A long running rule of thumb on the Nexus sites is that the ‘this user has done it so why can't I?’ excuse is NOT an acceptable excuse. Our moderation relies on users of this site to report content that is not acceptable so we can take action accordingly. We do not individually review every file or image that is uploaded to our servers. As such if content breaks our rules and we don't see it and no one reports that content then that content shall remain in our database until such time as we do see it and take appropriate action. Therefore if you see content that you think has broken our rules that does NOT mean we have endorsed that content and think it is acceptable. It does NOT mean you can upload similar content. We moderate content based on what is contained only within your file or image and your file or image alone. We do not take into account what other people have uploaded. If you get caught driving 90 miles an hour in a 70 miles an hour zone you cannot argue that you saw others driving at 90 and that you should receive no punishment because of this. We moderate based on the same principle.

Depends on the age of the music - the old classical works from composers (Beethoven, Mozart, Bach, Brahms, Tchaikovsky, etc) from before the introduction of copyright law are free to use, but anything that appears afterwards would have to be checked to see if reuse is allowed or not.

Age of account has nothing to do with anything.

 

Copyright infringement is copyright infringement. The Nexus does not make any exceptions. However in a site with over 10 million users, a few hundred modders and only a handful of staff they do rely heavily on the report system to find infringing material. If you've seen other mods with such material feel free to report them properly.

Remember, the RECORDING is also copyrightable - so if it was Brahms' music, but recorded recently enough to be copyrighted, it very well may be.

 

Check out sites that offer royalty free music- http://freemusicarchive.org/ (for example) has some tracks that are allowed for non-personal use (like in game mods or videos or whatever). You do usually have to give specific types of credit - just put it in your description on the Nexus and in your read me file. Won't hurt to find the 'free to use' text on the site and copy/paste it plus a link to it in both spots as well.

Barring that - you need written permission to use copyright work. Not sure how you'd provide that to the Nexus, but stating you have it, plus proper attribution as above, would probably serve - just make sure you have it if asked ... the Nexus doesn't want to get hit by some bizarre lawsuit or ISP ban-hammer for allowing piracy.
