does anyone know what happened to the mod and it's creator??

if you know what happened to the mod or it's creator or even both feel free to reply to this thread

Ps. I only found 1 rainbow dash level up sound and it's not the one I want

Considering that this Sound Effect is probably copyright material, and the posting of mods using copyright material (without the express written consent of the copyright holder) is against the TOS of the Nexus, it's possible the mod was deleted and the poster was banned.

if that's the case then how do we have fan mods at all?

By seeking permission of the original asset creator or through recreation of the assets, inspired by the original material rather than implementing them directly from another work.

After all it's not really fair for Ashleigh Ball, the voice actor, to have her work re-used without her permission or being paid for doing so.

there is the question of fair use though. considering mods aren't actually a source of income. Aren't other mods like the john cena fat man sound mod also against the rules then?

Fair Use is a legal concept in the United States, if you ever get sued it might be relevant but not using other people's assets is just Nexus site policy, it's got nothing to do with the law.

I don't know the mod in question, but if it's using someone else's work without permission, then it probably is against the rules.

Edit: If in doubt, you can always check with the site staff.

Man I just tried to read through the Nexus Site's Terms of Service and almost did it...kinda normal, but it applies UK law too, and Idk that law at all, other than what I see on tv, like a priest being arrested for saying a derogatory word for a man in his sermon. Otherwise, as I'm learning UK law and "hate speech" that is specifically protected by at least 3 US Supreme Court rulings in the US but banned every where else in the world...

Just say that Bronies are being discriminated against and that should help.

I wonder if, given the white lady that thought she was a black lady, if thinking you're a Little Pony, can that get around all law? I think it could, but I've only been an attorney pro se (a man with a fool for a client).

I'm almost certain, that bumper music and such has a time limitation such that they don't have to pay licensing fees, so I don't see why that can't apply here.

What is Fair Use?

The concept of Fair Use allows some 'running room' for educators, reviewers, reporters, researchers, and satirists who wish to use copyrighted materials as part of their work.

["what are you? a comedian?" Fk, yeah!]

Most of the time copying is not legally a fair use. Unless you have the author's explicit permission, copying usually violates the author's copyright. Some of the time Fair Use applies.

General Rules: The More You Use, the Less Fair Your Use Is Likely to Be!

  • Limit of 2 years on using materials in a multimedia teaching project
  • Limit of 10% or 3 min of motion media, which ever is less
  • Limit of 10% or 1000 words text, which ever is less
  • Use no more than 3 poems by 1 poet or 5 poets from 1 anthology, up to 250 words from a poem
  • Limit of 10% or 30 sec music from single musical work, can not substantially change music
  • Whole image but no more than 5 by 1 artist or photographer
  • Limit of 10% or 15 images single published work, which ever is less
  • Limit of 10% or 2500 fields or cells from a database or data table, which ever is less
  • No more than 2 copies of a project plus one back up not in use
  • Each creator can have 1 copy if multiple creators

The Four Factor Fair Use Test

Judgment of educational fair use is based on four considerations:.

  • The use of a copyrighted work is for nonprofit educational purposes.
  • The nature of the copyrighted work (is it appropriate for this specific educational use).
  • The amount of material used in relation to the entire work (10% is a rule of thumb).
  • The impact this use might have on the sales potential of the copyrighted work

Fair Use is a subtle concept, with many situational nuances. Are you posting the materials on a publicly accessible web site? If you answered yes to more than two of these questions, you may be violating fair use and copyright.

Quoted from: https://21cif.com/tutorials/micro/mm/copyright/page4.htm

From a legal perspective which I doubt Nexus (Not Lexus Nexus, this Fallout 4 Nexus) holds, even though we CAN use such material legally, their monetization model (which is probably from consumers of big data...hi big brother, and corporations!) has made them declare, an absolute ban of anything without an author's permission.

I didn't even know until I was asking how to use models from different Beth games, Nexus considers THAT, between Fallout3 and Fallout4 for example as copyright NO GOES. I went whoa, almost burned my butt without even knowing it that time!

All in all, the thing I find the most ironic, is as copyright actually gets up and running and strongly protects content makers, the only entities making content will be IBM's Watson and Google's DeepMind. It's too funny.

I did some searching and it looks like Hasbro hasn't been completely supportive of fan works. Apparently a group called Mane6 were making a MLP computer game and received a cease and desist notice from Hasbro for using their intellectual property. Although interestingly enough Lauren Faust, the character designer of the latest MLP series, created brand new characters for them.

Anyway, from what I understand Nexus wants explicit rather than implicit permission from the owners of intellectual property, so you'd need to contact Hasbro and get their permission to use the sample to put it on Nexus. At least so far as I'm aware, you may want to check with the staff site if you're still uncertain.
