ArcaneSaint
This whole thing started when Mojang (the company making Scrolls) filed a trademark request for the name "Scrolls" As I've said before on RPS, I thus think the main reason they're doing this is because according to US copyright law, you can lose your copyright if you're not defending it, so if Mojang takes a copyright on "Scrolls" they would have a copyright on a part of Bethesda's copyright "The elder Scrolls", which might result in Bethesda losing the Trademark, which would be very bad for them, leaving them no choice but to file a protest. Even though there would be a lot of community backlash. And although their wording may be unfortunate, we have only seen one page yet, and Legalese is a very confusing and obscure language where words don't have the same meaning as in English. I might be wrong, so if you have more intimate knowledge of copyright laws then please share it so we can shed a light on this situation. ~~ArcaneSaint Edited August 8, 2011 by ArcaneSaint
Tchos
@ArcaneSaint: Just to be clear, that's trademark law, not copyright law, which are very different.
grim2920
Bethesda has the right to site regulations on their own Copyrights and Elder Scrolls is a register trademark! A trademark is a form of copyright and should be treated as such. I hope justice is served and 3 hips should be awarded to Bethesda softworks for being on the ball. TDATL
Are you a multinational corporation with more money than you know what to do with? Do you feel your PR is a little too good lately? Want a way to waste your money and build bad PR at the same time? Don't worry. Your prayers have been answered. Just file a baseless lawsuit against an indie developer. Not only will you waste your own time and money but you will get a reputation as legal bully. Why spend that money on making quality products when you can just flush it down the toilet with frivolous lawsuits? Other great ways to waste money and get a bad rep include but are not limited to.. -Setting money on fire and throwing it at starving orphans. -Buying happy healthy adorable puppies so you can euthanize them. -Buying candy for a child and then stealing it back to make them cry. -Secretly funding a small developer, building up a loving fan base, and then publicly crushing it to show how evil you are. <--- My personal favorite. lGlK3A1vNI0B
LOL What a bullload of s#*!.Scrolls are also rolls of paper. This is just a big company with $$$$$ horney eggheads. If yeah read the text, it states that SCROLLS can never be used in any ways by anyone but Zemimax. So basic, they gonns slap me with a lawsuit now :). The arguement that Warcraft & Warcraft: Orcs can be compaird to THE ELDER SCROLLS and SCROLLS is just idotic. And they can not even wait for a courtruleing to get the cash? Pure money fishing. I hope this is a net scam and not Zemimax, they could lol blacklist them in the EU.
Garinov
Well this is very interesting information... I'm surprised Fall out boy didn't get sued and for that matter good thing I gave up trying to make a game about the elderly life and how hard it is to be when you're old called The Elder. CookedAndLoaded
Damn I must agree with NMC! To sue Notch because the upcoming "Scrolls" is a bad game and can somehow set a bad reputation on the TES series. OR that Notch is riding on the shadow of a remarkable series of great RPGs (TES). All that is OK! But to say we'd be confused by the name of the game!? Like we'd not look at the Publisher/Developer behind the game, thats like calling us fools! Besides, your advertisement sector is very competent at the brainwashing propaganda they do for Beth's titles. I wouldn't miss one game(of yours)! xD
mooglebye
The thing is... Its two titles in the gaming industry, if it were a book called Scrolls, it wouldn't matter. I am glad to see that Bethseda cares about it's copyrights and trademarks and is willing to defend them. The argument of World of Warcraft to Warcraft: Orcs and Humans is perfect for this case. If you believe that this is simply to gain money, or abuse power, you can take your arguments somewhere else. This is simply about keeping their trademarks and making sure that newcomers to The Elder Scrolls series does not mistake "Scrolls" to be either Bethseda's works or an associated company's. Well I hope this comment will be read and will get people to realize that what Bethseda is doing is the right thing.
CookedAndLoaded
@mooglebye If they worry so much about "newcomers", then state that! Loosing loyalty of the "oldcomers" is not good for business either.
ambitiousFish
Bethesda doesn't OWN the word "Scrolls". They're sueing Notch for no reason. Or to be more exact, they're sueing Notch because they're big babies.
