Pay a commercial 3d artist to make a mesh model of artwork of my own creation, then pay another artist to texture it, pay someone to turn those Meshes and textures into a working mod and then put the mod up for free download!?

no you cannot do that.

As far as i can see with limited legal knowledge, the rules only apply to making money in any way or illegal use of any Bethesda copyrighted assets and making money from the mod itself. They do not apply paying someone for custom meshes, textures, animations and creating the mod, then offering it for free to everyone, which is the case/question here.

they dont allow money transferring hands at all for the mod creation process.

I was intrigued by how far the legal rules go and did a litlle bit of digging and it's not that clear cut.

Right up to the part where you start using the creationkit Bethesda has no influence and legal rights to how you obtain and create the files. So i can pay somebody for all the work right up to where you need the Geck and extensions owned/licensed by Bethesda to get the items in game. Bethesda has no rights over the 3d program you use to make meshes (they have no legal power over Blender and what you create with that and how, same for Photoshop or anything else you use for texturing and animations) There is no way for them to take any legal action if you payed someone for the work done right up to start using the GECK and converting the files to Bethesda licensed/owned file extensions (mainly ESP, ESM BSA. Could not find anything about the texture and mesh extensions)

So you are only not allowed to pay someone for actually making the mod in the Geck, you can pay for the models and all the work but then you have to convert them yourself to Bethesda compatible format and use the GECK yourself or ask someone to do it for you for free.

That aside from any rules on asking for money and people to do it for money on this or any other websites.

okay now we're entering some serious legal talk that i really don't want to go super far into as i am not an 'expert' on it. honestly be safe and dont involve money in the modding process.
