Im not entirely sure but you may even level down I've honestly not noticed. I did look in the book and turns out that yes, you lose your progress towards your skills leveling. I think I've never actually noticed because unlike Morrowind, which actually told you that your skills decreased, Skyrim doesn't. Which is most likely why I've never noticed at all. I'd still be interested in seeing an "escape your execution" mod if possible, though there's a lot of other things I think I'd rather see first. One of the loading screen tips tells you this and it shows up quite frequently for me for some reason. Strange, because although my character has committed a few crimes and stolen her share of things, I've never had a high bounty or gone to jail yet. Maybe the game is trying to warn me.
