NCRranger5x
hello anyone reading first of all sorry if i posted this in the wrong place or if the question is a bit stupid, what im wondering is if i had gotten models and textures from another game (id never upload those straight to nexus i know a little better than that lol) and altered the textures and model enough to be classed as an original creation would they be safe to be uploaded to the nexus? this may sound like a stupid question but im currently doing business and a few 3d model creation courses and i was told in the business course that once a model and texture are changed to a good extent they are classed as original projects and are allowed to be sold (not that i would i dont even want donations or anything like that) but apparently also safe for non commercial use in most countries im going based on what i heard from my instructor so thought id ask if it would be ok if i was to share the mask on the nexus, originally i didnt want to release this mask and only intended it for personal use but im getting a lot of people asking me for it and i politely refuse but if it is classed as an "original" project id happily upload it for others ill attach some images of the mask in question below  thank you for reading this and if im completely wrong about how the copyright law covers "original projects" forgive my stupidity xD
Crimsomrider
I've been following your WIP images and I immediately took note of the mouth part of that mask. I figured I was just crazy, but... is that a mask from Aliens vs Predator ? The front mouth piece looks awfully familiar from a Predator mask in that game. As for the copyright, I do agree that logically changing an asset to such extent makes some sense that it's your own, but I don't think it is. Think of it this way, you build a house on a foundation that is not yours. No matter what you do, you own the house, but the foundation is never yours and if the owner says they want you to remove your house from his foundation, he's legally correct. I can't be 100% sure, but I personally always make mods from scratch, even if I took inspiration from someone else. Even a simple material file that has the exact changes as my own, I'll rather do a material file from scratch than take an existing one and change some values. If that mask part really is from AWP, then I'd say it's not an original asset because I was able to recognize it from a mile away and I haven't even played that game in a long time. DoctorKaizeld
I believe it has to be 70% changed to count as an original creation. That mask has not been changed enough to count so no you cannot upload it here.
NoddingOff
Copyright in Derivative Works and Compilations. U.S. What you have would likely fall under a derivative work. Right to Prepare Derivative Works Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create, an adaptation of that work. The owner of a copyright is generally the author or someone who has obtained the exclusive rights from the author. In any case where a copyrighted work is used without the permission of the copyright owner, copyright protection will not extend to any part of the work in which such material has been used unlawfully. The unauthorized adaption of a work may constitute copyright infringement https://www.copyright.gov/circs/circ14.pdf Hope that helps.

Negative feedback rarely helps. Better to provide relevant information, so anyone coming across the thread who may have similar questions, can learn -- also, less chance of drawing the Mod's ire and getting the thread locked. SirSalami
NCRranger5x, While there's something to be said about transformative works especially those in pop-culture, we are not a law enforcement or interpretation agency. It'd be in your best interests to seek council from a copyright lawyer or from the actual property owners regarding legalities. Our community is quite sensitive to these issues as you may know. So if you were to post it, for the sake of transparency, describe the nature of your file with proper accreditation and sources regarding any repurposed content. Of course, removal of the file would be immediate upon request of the property owner or representative should they feel that your submission is infringing on their property.
