l3lacklagoon
You're right I won't make a guide because I don't want to f*#@ it up and then f*#@ up some poor person's game. I want to hand out fixes for a mod that hasn't been touched in over a year and a half. Because I want others to have fun while playing the game with some of the same experiences I can have thanks to this mod. As for the backwards world I live in, people are constantly testing Copyright and Patent laws and it is left to the starting companies to defend themselves from this. Now looking back I was using this in the wrong context so I do apologize
DoctorKaizeld
handing out the files individually is also against copyright law
l3lacklagoon
That is where you are wrong using code of other people as long as you change it enough to be unique is not against the copyright law. Which I am doing in the Fixing of the Perk. Now if I was using art assets or the like yes. But thankful you can't copyright code outright.

l3lacklagoon
Please do. If I'm actually wrong about that I will delete my other comments I left on the mod's page and completely forget about this.
Jannifer
Here is Nexus's position, straight from the Terms of Service... "Absolutely no copyrighted work is to be used without permission of the original creator. This includes content from other games, from DLCs, music creators or from other file authors. This also includes members from countries that do not recognise copyright laws. All files uploaded must have been created by the uploader or used with permission from the original author of the content. Such permission must be indicated in the Readme text attached to the file and/or on the Description page (or in the Description field for images), and must be obtained in advance, before uploading the file. If you cannot provide proof of consent then your file will be removed...." If someone reports a file as stolen, we ask for them to provide proof of said theft. Side by side screenshots which compare the original assets, including scripts, to the challenged assets are invaluable. Records of conversations where the original author either gave or withheld permission are also good. Mod upload dates and the dates on the questioned files are also taken into consideration. Much goes into making a decision on whether or not a mod contains stolen content. Often, more than one member of the staff looks at the proof also. We do rely heavily on users reporting suspicious content. Even though Nexus staff members may run across problems in their normal use of the site, we do not vet every single mod that gets uploaded. Now, if you really want to understand the law regarding copyright, then ask a lawyer or attorney. Do understand, however, that copyright in the United States is conferred automatically as soon as a work is written or created. The US does not require any kind of registration for copyright protection.
l3lacklagoon
ok thank you for this so it is not against the nexus terms of service to hand out fixes individual. But to upload a fix for the mod in question is against the ToS without the mod authors permission (even if the mod author is no longer a user on the sight.) If I'm interrupting this wrong please let me know.

If I'm interrupting this wrong please let me know.As long as your fix for the mod doesn't contain any assets (including code) from the original mod, you're good to go. If it contains any assets whatsoever that you did not create in whole yourself, then if you don't have the permission of the original mod author, you cannot upload it to Nexus, and distributing it outside of the Nexus (for example, via email, other website or hosting service) will be a breach of the original author's copyright (which is a bannable offense on Nexus if someone is found to be doing that)
DrakeTheDragon
This section of the ToS would be of note in this context, handing out individually, here: The posting of any copyrighted material, unless the copyright is owned by you or you have consent from the owner of the copyrighted material, is strictly prohibited on any Nexus site. This includes linking to sites that contain copyrighted material used without permission of the copyright holder. Legal inquiries regarding copyright infringement are taken very seriously on Nexus sites and we will work with any legal body to identify and bring to justice anyone who might use a Nexus site to share copyrighted material. So even uploading somewhere else (free file sharing hosts, other sites, torrents, etc.) and just spreading the links on here would be a violation of these terms.
