I don't know if EA's stand on modding counts for all their games, but it is likely that Spore is off limit since they still have 'active' games based on Spore (such as Darkspore and a planned game called 'Spore Creature Keeper' this year). Also, modding for Spore is like skating on thin ice. The game isn't really that popular anymore and hardly any of the players left even mod it.
