The best anaology here really was with cars.

 

There is absolutely nothing wrong with modding/altering your xbox, in the same way there is nothing wrong with tuning up a car, and allowing people to do so does not pose ANY issues for the original manufacturer.

 

In both cases you own what you're fiddling with.

In both cases no reasonable person would expect to still be covered by a warantee if they did so.

In neither case should the original manuafacturer or ANYBODY ELSE be able to say or do anything about it.

 

Until...

 

The only point at which anyone else gets a say is when you take your newly modded/tuned product out in public - at the point when you connect to xbox Live then Microsoft has every right to say you aren't allowed with a modded machine, in the same way that when you drive a car on a public road, or at a race track it has to meet safety standards.

 

In both cases the original manufacturer should also be able to stop someone from selling their modded/tuned creations (certainly they should be able to demand their branding be removed), but in absolutely no situation whatsoever should a manufacturer be able to dictate how their physical product is used or abused by it's end consumer.

 

If they want to dictate end use and non abuse of hardware then they have to start making you sign a rental contract like when you get a "free handset" from a mobile operator.

Exactly. You said this a lot better than I did, and more expansive. One other thing to add though. XBox and PS fall under patent and copyright protections as well. When you start making copies, or modifying hardware you better be darn sure you know what you're doing with said copies or mods.

Yep that's why they should be able to stop people from selling etc modded xboxes.

 

I can't get on my high horse too much about freedom from IP and copyright, I'm a photographer of sorts and have had a couple of my pictures used without permission, payment or credit, but ultimately it should all be about common sense more than the letter of law. With my photos when it's someone using it as their myspace background you don't mind, when someone uses it as a background in a myspace template layout for download on their site which they earn ad revenue for, you get annoyed enough to send them a legal threat and an invoice.

 

I trust myself to be able make that nuanced decision, I don't trust a corporation to be able to ;)

I'd say its because of Beths terrible game engine. I mean, some people get CTD and terrible stuttering on the VANILLA version. Throw an extra 100-200 NPC and bam, you've got a game that's not only going to CTD and be insanely unstable, but after the reviews go out, isn't going to sell a single copy!

Consoles are probably better for interactive movie types of games (RPGs, shooters) because you can just hang back and press buttons.

 

PCs still have the competitive side - games like DotA, League of Legends, Guild Wars and Diablo that are more about gameplay than graphics or story and require more involvement/knowledge from the player. They also have the cutting edge graphics people (of which there are few: Crysis 1 was a sales bomb).

 

And that's probably how it's going to stay for a while...
