You can convert them but you can only use them for personal use, you would not be allowed to distribute them as its copyright infringement.

Yea for some idiotic reason ... It's not like you make a profit from it and it's a TES game ... Cmon you can take meshes from other games and import them everything's fine but when it comes to Beth games they say no ... It probably goes as "Steal from other gamemakers for us so we won't get sued but don't steal our profit ! " :P .

Not idiotic at all. Some of the asset is not Bethesda, and if people would "rip" it off the original game it would be considered theft. Even if it is only from Oblivion to Skyrim.

Secondly it makes it easier for people to make "mods" as Morroblivion, which is not approved by Bethesda. Basically it kills the idea of them doing a remake in the future, which is a money cow. That is a indirect loss of profit.

 

Breaking the copyright law is illegal, and Bethesda has stated that the orignal asset may only be used in the original game. That way they won't get sued for sending models not made by themself out on the internet, and they got their options open for remakes.

It's a win - win situation. Since, quite frankly, if somebody needs a model they can make it themself with 10 times the quality. Based on the fact Oblivion was made in a time it was not possible to get the details we can get today.

 

Now, with that said, you can port models for your own use. Just don't release it, and don't speak too much about it. Try to reelase it, and it will most likely get banned, with you, and at worse you get on the bad side of Bethesda. Which is not good at all.

I don't know where you got the idea that game makers allowing their assets to be used in other game is a common occurrence. There are very few game makers that allow using their assets in mods for other games. We do know of 2 who have said their stuff can be used in mods for other games, and we do allow those here. :thumbsup:

 

Beth does not own some of the assets for their games. They license assets from an assortment of third party programmers that do that for a living. These programmers actually expect to be paid for their work whenever it is used. (programmers have to eat too) The license for use of an asset is for that particular game only. If Beth allowed us to use those assets that they don't own for some other game (even another Bethsoft game), they could be sued for violating the license, and those 3rd party programmers would no longer be willing to license their stuff to Beth for future games.

 

Note: they license assets to speed up development and 'why reinvent the wheel' if you can license it for a reasonable price.

 

The probability for a modder being sued is likely very low. However, the probability for a high profile modding site with millions of members being sued for allowing those mods is very much higher. Since we don't have the extra cash available to pay for a gang of lawyers to fight those kind of suits, we just don't allow mods with known rips from other games that don't allow it. (Most likely we would first get a nasty letter demanding the infringing mod be removed, and the identity of the modder so the lawyers could hassle them too.) :pinch:

 

However, we do allow original remakes of assets resembling those from other games. If we suspect it isn't original, it's easy to overlay the mesh from a mod onto the mesh from the other game and see if they match. When you do that its obvious even if they do change a few bits from the original in an attempt to hide it.

What you can do is that you can recreate them from scratch and then use them. Say you fancy a certain chair in the game and want it in Skyrim for a mod you're creating and releasing. You (or someone else) would have to start up some 3d modeling software like 3ds max, maya or blender and recreate it from scratch. I'm not sure what the rules are for using reference pictures but I think that's fine as long as you do create your own model.

Ben.. If I understand things correctly, the main issues is sharing content over the internet, so that people can't use it without having paid for the game. So you could potentially create a program or even a mod that uses Oblivion resources as long as you didn't share the actual nif, dds, etc. files?

 

Also, if I understand it correctly it shouldn't be against the rules to discuss how you would go about the process, because again the issue is the sharing of copyrighted material, not that you can't do it for your own personal play if you've already paid for the game.

 

Do I have that right?

Sorry I should of explained more, if someone created new meshes and textures for use in oblivion can you transfer them to Skyrim since they are not Bethesda property?

 

That would be entirely up to the creator of the of the Oblivion mod that contained the assets, but I wouldn't bet on it.
