Dark Brotherhood and the Civil War

My main concern is if you don't join the Dark Brotherhood (in other words, destroy them), are you obligated to side with the Empire than the Stormcloaks? Because if the Stormcloaks win, respawning Stormcloak soldiers will keep attacking Dragon Bridge and your "new friend", Commander Maro.

I don't think you're obligated to join the Imperials. You could stay out of the are altogether. Even if you're a Stormcloak, as long as you're not in the group attacking Dragonsbridge it's not such a big deal; you can have conflicting loyalties during wartime, and liking someone on the opposite side doesn't mean you have to stand there with a sword and protect them from your fellows or anything.

As I said, the Brotherhood can be hated by both sides of the war.

If Ulfric and Galmar wanted to make Skyrim a safer place by destroying the Brotherhood, I'm sure they'd assist the Emperor's Bodyguard in doing so. This isn't a a civil war issue, its just an issue that both sides may want to be taken care of.

Furthermore, after you destroy the Brotherhood, even Windhelm guards say stuff like "You destroyed the Dark Brotherhood, I owe you a drink".

I've been asking around for a mod that removes the Penitus Oculatus from Tullius's Legion, so there are no more Stormcloak scuffles, but to no avail.

Ahh, that's the issue. Its not philosophical, its practical.

In the future, destroy the Brotherhood before joining the Stormcloaks. That's all I can suggest.

Does it make sense for the later Dark Brotherhood quests to happen if you already won the Civil War in favor of the Stormcloaks? Would the Emperor really be stupid enough to dock his ship in a harbor of a now "foreign" land? Conversely, if you do the "Destroy the Dark Brotherhood" quest and become friends with Commander Maro (he even attends your wedding), does it make sense to ally yourself with the Stormcloaks, enemies of the Empire?

I prefer to handle the Dark Brotherhood quests prior to the Civil War, since winning Solitude for the Stormcloaks erases the bounty my Dragonborn incurs when he attempts to kill the Emperor. For me, it made more sense for the Emperor to dock in Solitude if it was under Legion control, since I have my doubts that the Emperor would go into Solitude if it was under the control of the Stormcloaks.

My Tribunal mage destroyed the Dark Brotherhood and sided with the Legion, so I avoided that problem between game and story segregation (since Commander Maro and the Penitus Oculatus work for the Empire).

Consider it this way;

Emperor loses rebellion, his nobles are unhappy and see him as a weak leader. (I gather the lore is the Empire has already lost a war with the elves) There is qdiscreet talk it might be time for the Emperor's son to succeeded him. Desperate to regain control the Emperor refuses to publicly acknowledge the Stormcloak victory, then travels to Skyrim to show the outside world Skyrim is still part of the Empire, Meanwhile, privately he is conducting diplomacy to work out some kind of face saving compromise (not entirely unreasonable since the Stormcloaks are facing the possibility of an Imperal war of revenge)

This is the last straw for the Imperial elite, someone does the dark ritual, a contract is put out on the Emperor and it's just business for the Dark Brotherhood after that.
