I'm looking at creating a mod combo pack which uses assets from several existing mods. I'm able to request permission from most of them, but at least one author hasn't visited the site since June (Specifically, Grimoa). They are also not taking PMs. Do I have any recourse? Matth85 Posted October 28, 2013 Share Posted October 28, 2013 Not really. Unless the person has said the mod can be used for whatever purpose, which most actually do, you are in the dark. You can, of course, go do some interneting and see if you can find out who the person is on other forums, or perhaps some friends that know him/her. Other than that I don't think you can do much. I have not read the Nexus rules for uploading, but I don't believe they got any right to any content, so not even they can override that. Don't quote me on that though! To be specific, I've taken Grimoa's plantigrade feet and restored the more "vanilla" UVs for the meshes so that they can be more easily used with various Khajiit retexes. No parole, no reprieve, End Of. And now that you've brought attention to it, your only recourse is to exclude anything for which you do not have written permission. That is not actually true. It's nothing to do with law. It's just the site rules and a courtesy to mod makers. The copyright and all rights to ANYTHING made using the CK actually belong to Bethesda. That's how they can pinch good ideas to put into their games. Using something another mod maker has created (whether with the CK or whether things like custom meshes and textures made with software other than the CK) is just bad form, rude and considered mod theft and will get you banned. It will not land you in court. Copyrighted music is an even bigger No-No. Using even a 10 second clip of a rock song from 1970 in a mod will get you banned. I asked! Stupid, I know, as the worst that could happen is people think "What a crap song". The best that can happen is they think "Wow, I've got to get the CD!" So who loses if I upload it? NO ONE BUT ME AS I GET BANNED!! Who loses if I do NOT upload it? EVERYONE! ME, MOD USERS, ARTISTS, MUSICIANS, SONG WRITERS, LYRICISTS, RECORD COMPANIES, EVERYONE! But that is the Nexus Rule. OP, making a patch for someone else's work is usually not frowned upon by anyone, but you must get solid, written advice from an Admin member before you upload it. However, try to touch anybody's model, texture or any other self-made asset, and you got your law against you. Either way, it's not worth doing. Pevey Posted October 29, 2013 Share Posted October 29, 2013 Making something with the CK gives Beth a license to it. It doesn't give anyone else a license to it. So, yes, using it in some way for which the author doesn't give permission (a license) DOES violate copyright law. The interpretation shady cites above is an intentional misreading of the TOS of the CK used to rationalize stealing mods, so please don't repeat it. That said, I strongly support more generous permissions with mods, such as a Creative Commons license. Sharing your toys is what the cool kids do. :).
