I have the same problem, but with an Oblivion mod. I sent a support ticket, just sent an email directly to a staff member there but how do I contact this Peter person?

 

I will email.

Then I will fax.

Then I will telephone.

Then I will send a C&D.

Then I will turn up to their office myself. If that is what it takes. :biggrin:

Just read the 1st page but the upload is NOT automated,some user has gone to the effort of finding and re-uploading your mod.

Also throwing together fake C&D letters work absolute wonders with these sorts of situations(I like to imagine someone in the office shouting "CODE C&D,REPEAT CODE C&D,MODERATION TEAM CHARLIE EXECUTE PINEAPPLE SCENARIO GO GO GO GO")

There is no such thing as a "fake" C&D letter (you do not require a lawyer to send one for you, and knowingly sending one for something that isn't yours is unlawful and would probably fall under some sort of fraud). However, they (File Planet, specifically) ignore the C&D letters from what everyone has said in my thread posted above.

You want to be sending DMCA take-down notices, not C&D letters. You can find lots of examples of DMCA letters online, you just need to edit them as appropriate and you don't need a lawyer to do it, or a lawyer to send it, for it to be taken notice of.

 

IGN should not be ignoring DMCA take-down requests and I'd be surprised if they were. Needless to say, however, that they should not be stealing this content anyway. Pathetic practise from a site that's becoming less and less relevant. I feel sorry for APY and PES who have to be linked with the dolts doing this stuff at Fileplanet.

I finally got a reply from File Planet (5th time was the charm). It seems their DMCA Agent email address has an over-active filter (is this a "go figure" or a "yeah, right" ?). To ensure the appropriate people get your notice be sure to include "Re: Copyright Claim" in your subject when you email [email protected] -- I had emailed it before, but as with the support tickets requesting removal and emailing Peer Schneider, didn't get a response. This time I got a response within 1 business day.

Send them a DMCA takedown notice. If they refuse to take it down within 72 hours send iot to their upstream bandwidth provider. You and do a whois and see who they use as a registrar and whatnot. Send DMCAs to them. Legally, all it takes is a few people doing that and they will be shut off completely. No more fileplanet.
