Explicit permission needed but modder left a year ago.

So there is a mod I would like to port to SE/VR. But the author left about a year ago and left the following message:

"I have decided to leave modding.

That doesn't mean you can use my files as you see fit. If you want to make changes to my files and upload them somewhere for public scrutiny you have to have my EXPLICIT permission."

Does this mean his mod is (probably) for ever lost?

what if you had the idea of it. but the code / design is completely different? would the idea itself be acceptable to use / use in bad faith / shouldn't be used at all.

-edit - I add on to this convo bc my thinking is. at some point, all the main ideas will be taken, and If you're not allowed to use said ideas (not the code or actual work) then at some point in the future, no one will be able to do anything

if you make it yourself its fine. they own the mod not the idea

Yes, those kind of situations are always saddening. Particularly when I a game updates and makes mods unusable. But again, here we respect the author's wishes, and as is inevitable, all things fade away in time.

It's not uncommon that we have mods that do the same, or very similar things, based off different ways of accomplishing them. Or, if the method is accomplished by a very easy to use method, that could be commonly used by anybody.

But as was mentioned by the good Doctor I'll give the second verification that yes. It's the mod that is owned, not the idea.

As an author tho, I would recommend that in your mod description, that you make mention of how your mod differs from the other. Even if those reading it don't understand what you're saying, it makes it obvious that you're not trying to directly copy somebody else's work. As a goodwill gesture, if you will.

You could leave a message a the mod's comment thread asking for permission. The author might still be looking in from time to time. It happens. :)

Your words suggest your creative thinking has a + sign growing there in, because you like the mod so much that it's the driving force. Play with the mod on your machine. Let your idea play on your mind and grow. Use the CK to mod and make your own attachable parts to it.

Without cutting up or calling a mod your own, mod your idea as it has grown. Keep your mod as a separate part to upload to where ever you want and share it however you want.

Then you don't step on anyone's fingers who spent all their time to please others.

You can go to the mod author's profile page, and it will show the last time the Mod Author was active.

If you're in luck, it will be a very recent date, like today or yesterday, otherwise, if it's like 2015, then...

I have two mods, both of which have a link to a spot. Great mods I downloaded are there in my game. I am playing them on my machine.

In the Morrowind mod if the mod I liked were on that spot on the surface of the land the player lands on the roof of that other persons modded home instead of on the ground where none would be. Like a Thief sneaking in from the rooftops. If the building isn't there the fall is so short the character doesn't die if the mod isn't there.
