GLITCHEDMATRIX Posted December 13, 2015 Share Posted December 13, 2015 Hello fellow modders. I recently started modding Fallout 4 and only uploaded 2 mods in the past 2 days. Well my problem here is the 2nd mod I uploaded "violated policy" due to copyright infringement. The mod included 5 second clips of songs that play when the mysterious man appears. Being a youtube partner for over 3 years I have encountered situations like this more often than I should have. So with that experience gained, I was able to find ways around copyright infringement. It was also stated that if the clips last more than 5-10 seconds, its considered a violation if I don't own the rights but as long as I am not gaining revenue it doesn't get removed. Well in this case my video contained these clips, youtube hasn't given me any notifications about these songs because the clips are too short to validate ownership therefor its not enough to infringe any copyright. My video is still up and I am gaining revenue from it. However, on this website it was taken down and I received a seemingly indefinite warning and restriction since it tells me this... Well I did wait "A minute" in fact a day. So is this it for me here? Do I need to create a new account to be able to upload mods on this site? I mean I download here very often I would hate to part ways and had no idea how serious they were about music, Its almost hypocritical because there are plenty of mods here that involve copyrighted songs being added to the radio stations..... .... .... ... .. . . This includes linking to sites that contain copyrighted material used without permission of the copyright holder. Legal inquiries regarding copyright infringement are taken very seriously on Nexus sites and we will work with any legal body to identify and bring to justice anyone who might use a Nexus site to share copyrighted material." "Absolutely no copyrighted work is to be used without permission of the original creator. This includes content from other games, from DLCs, music creators or from other file authors. This also includes members from countries that do not recognise copyright laws.All files uploaded must have been created by the uploader or used with permission from the original author of the content. Such permission must be indicated in the Readme text attached to the file and/or on the Description page (or in the Description field for images), and must be obtained in advance, before uploading the file. If you cannot provide proof of consent then your file will be removed and your account is likely to be banned." "The "others are doing it" excuseA long running rule of thumb on the Nexus sites is that the ‘this user has done it so why can't I?’ excuse is NOT an acceptable excuse. Our moderation relies on users of this site to report content that is not acceptable so we can take action accordingly. We do not individually review every file or image that is uploaded to our servers. As such if content breaks our rules and we don't see it and no one reports that content then that content shall remain in our database until such time as we do see it and take appropriate action. Therefore if you see content that you think has broken our rules that does NOT mean we have endorsed that content and think it is acceptable. It does NOT mean you can upload similar content. We moderate content based on what is contained only within your file or image and your file or image alone. We do not take into account what other people have uploaded. If you get caught driving 90 miles an hour in a 70 miles an hour zone you cannot argue that you saw others driving at 90 and that you should receive no punishment because of this. We moderate based on the same principle." And regarding your idea of creating a new account: "One account per personMembers are only allowed to be in possession of one account on the site. Members caught using more than one account will be regarded as attempting to exploit or circumvent features on the site and will have both their accounts banned. If you are experiencing problems with your account please contact the admins using the Contact Us links on the sites and we'll work to resolve the issue for you." FYI All Fallout 4 radio songs are copyrighted and are blocked from recording on consoles. When a video is produced, the music is missing automatically to prevent any infringement. As far as linking to a video that contains copyright, as I said, my clips are not long enough to violate. And also, most of the music or audio mods here are from copyright owners. Cheers. If you didn't make it, you get permission, or you don't upload it. That's nothing to do with copyright and everything to do with our rules. So please, stop talking about copyright laws and read OUR RULES. The rules you specifically agreed to when making this account and then again (with further clarification on this exact rule on the uploading page) when you ticked the box when uploading your file. Here's the text from the file adding page, again, to remind you: I testify that all the content in the files I am going to upload are my own or are used with the express permission of the original creators of the files I have used and I have properly credited the original creators in my ReadMe, and in the mod description or in the "Credits" text area of the "Distribution permission" section of this page. I understand and accept that I will be banned from this site if I am found to be lieing about this. You have to tick the box next to that text else you can't add a file to the site.
