Coding the check into the installer, as T-Mush-S says, is almost certainly it. And yes, it's a legal thing for the Skywind team to cover their asses, not Bethesda being greedy or shady. Bethesda's official stance is basically to not talk about it and feign ignorance. It all has to do with the way US copyright law is set up.

Skywind would be a complete overhaul mod, it will absolutely require Skyrim + Dragonborn + Dawnguard to function. If Skywind is released as an application like Mod Organizer it could quite easily require that the Morrowind files are referenced and that they are checked on startup. The reason Morrowind is required is that although U.S. Copyright law allows "Fair Use", a complete remake of a game would not qualify, and Skywind could be taken down if it did not have this restriction. The only ways Bethesda could change this would be taking over the project themselves or making Morrowind free. Edited by Rautherdir

I guess you guys are fairly new to the tesrenewal stuff, and probably new to TES modding in general. In the past, the devs for Morroblivion (same guys working on Skywind) made the installer check for a legitimate Morrowind installation folder. And even if you defeated the copy protection on the installer, things still wouldn't necessarily work right. Just please, stop being cheap, buy Morrowind GotY on Steam, it's only $20 USD. It's still enjoyable in its original state today, so it's win-win.

And to those people saying, "But it's a SKYRIM mod!! We shouldn't have to buy another game to use it!!":

This isn't your average Skyrim mod. This isn't even your average New Lands mod that is either incomplete/buggy or only 1/4th the size of Skyrim at most. Skywind will easily be bigger than Skyrim itself, at least worldspace wise. They're even talking about giving it its own executable and install folder, which is not something a normal mod would do. So please, stop whining, put the $20 down if you want to play it when it comes out. Get a job, or beg your parents. Just stop whining.

Yes. If you don't own it, the installer will not let you play. This isn't anything new for them, they did it with Morroblivion too. If you use a cracked copy of either Morrowind, Skyrim, or both, Skywind will not work right, and people will either refuse to help you (in my case) or won't be able to help you, as cracked copies tend to have idiosyncrasies that make it hard to troubleshoot.
